| China ’ s real estate industry has long existed the phenomenon of “ heavy selling but light renting ”.In order to improve the negative impact of this phenomenon,China has begun to build a multi-level housing supply system of “renting and purchasing simultaneously”.Under the policy support,the housing rental market has created the golden age of industry development,long-term rental apartments are also emerging in the rental market.It has broken the traditional way and made China ’s housing rental market enter a new era.The long-term rental apartment has created a new business“rental loan ”,and formed a model of “long-term rental apartment + rental loan ” with third-party financial institutions,which has stimulated the diversified development of China ’s consumer financial market to some extent.However,because the long-term rental apartments are just emerging,the “ rent loan ” is also unstable.So there are a lot of legal supervision problems,for example,the lag of regulatory laws,the lack of supervision of the capital pool,and the tenant is driven out and so on.In addition,in2020 the COVID-19 Outbreak has caused a certain impact on the financial market and caused the long-term rental apartments go bankrupt.In the end,the bankruptcy damages the legitimate interest of the tenant and affects the stability of China’s housing rental market.Therefore,this paper analyzes the bankruptcy cases of long-term rental apartment in recent years and the theory of “rental loan”.Firstly,the paper summarizes the theoretical concept and characteristics of long-term rental apartment and “rental loan”,sorts out the legal relationship in the process of “rental loan”trading,and explain the harm and the reasons for supervision.Secondly,based on the bankruptcy cases of long-term rental apartment,this paper from the perspective of legal supervision issues studies the supervision deficiencies of “rental loan” in China from the aspects of supervision system,supervision department,rights and obligations of the regulated,interests of the tenant and so on.Finally,in order to strengthen the supervision of housing rental field and provide references for the development of industry,strategies and suggestions for the development of long-term rental apartments “rental loan” were proposed from the perspective of supervision. |
