In the process of promoting the reform of the housing system in our country,rent loans have emerged based on actual needs.As a new type of financial innovation tool,in fact,it is conducive to the more prosperous development of China’s consumer financial market.Online lending institutions such as p2 p online lending and Internet micro-loan companies are combined with long-term rental apartment rental agencies to form a "finance + long-term rental apartment" model.On the surface,"pay one pay one" is more effective than the traditional "pay one pay three" to ease the pressure of renters on short-term rents,and it can also make landlords no longer have to collect rent.However,the "rental loan" business has exposed many problems in its operation.This article intends to analyze the legal problems existing in the field of long-term rental apartment rental loans in China,elaborate on the business model and causes of rental loans,and propose some legal suggestions on how to regulate the use of rental loans.Specifically,this article has three parts,namely:The first part mainly expounds the basic theory.It is divided into two aspects: first,a brief introduction to rental loans,and by comparing it with P2 P online loans,the concept of rental loans is derived,and the causes of rental gold loans are summarized;second,the main business models of rental loans are classified The study also analyzes the various legal relationships involved in rent loans,and rationalizes the operation mode of rent loans and related subjects.The second part mainly analyzes the legal issues involved in rent loans.Relying on the current situation of the development of the long-term rental apartment market and Internet finance,the legal issues faced by the parties to the rental loan are summarized.It is divided into the following subjects: First,there are legal problems with long-term rental apartment renting agencies.The legal nature of renting agencies is unknown,the fund pool is not regulated,and fraud is suspected.The second is the irregular operation of online loan agencies and the lack of information disclosure mechanisms.The third is supervision Institutional responsibilities are ambiguous,the Interim Measures have too little legal effect and lack uniform regulatory standards.The third part is mainly related to the legal suggestions made on the above issues.This article lists the following suggestions: one is to clarify the responsibilities and authorities of the regulatory body,strengthen the construction of the credit system,etc;two is to improve the management of long-term rental apartments,set the entry threshold,and clarify the legal nature of long-term rental apartments;Strengthen the supervision of online loan institutions,improve the information disclosure system,etc.
