| Along with rapid China’s urbanization process development and the in-depth promotion of urban-rural integration,increasingly,rural population transfer to cities,giving rise to a great many of rural homestead idle.According to statistics,among the nearly 200 million mu of rural homesteads in China,there are more than 30 million mu of idle homesteads,worth about 63 trillion yuan.A large number of idle rural homestead is not only a great waste of land resources,but also further aggravate the imbalance between urban and rural land,leading to a gradual increase in the gap between urban and rural,hindering the sustainable development of urban-rural integration.At present,the main problems that a large amount of idle rural homestad is difficult to be put to good use are that the relevant legal system is not perfect,the way of use is simple,the standard of use is not clear,and the protection of farmers’ rights and interests is difficult.As land reform implementation and homestead and separation from the safeguard function gradually to the property features under the background of expanding,rural idle land use under the perspective of urban and rural integration and in-depth study on the legal issues,is conducive to play to rural idle homestead land efficiency,benefit for using the system for rural homestead management and provide legal support,farmers’ land rights and interests safeguard to promote flow between urban and rural areas,accelerating the development of urban and rural integration.This paper is divided into seven parts.On the basis of discussing the theory of the utilization of idle rural homesteads under the integration of urban and rural areas,this paper clarifies the classification of idle homesteads,sorts out the regulations and policies on the utilization of idle homesteads,and clarifies that there is a close relationship between the integration of urban and rural areas and the utilization of idle homesteads.At present,there are four main ways to use the unused homestead in rural areas,including internal circulation,transformation and utilization,home stay development and paid withdrawal.At present,there are some major problems in the utilization of rural idle homestead in China,such as imperfect system,imperfect way,unclear procedure,unclear standard and difficult protection of farmers’ rights and interests.Through the practical investigation on the utilization of unused homestead in the pilot areas of Yiwu in Zhejiang,Yujiang in Jiangxi,Jinzhai in Anhui,Luxian in Sichuan and Gaoling in Shaanxi,the author obtained the experience and enlightenment of perfecting the system norms,innovating the utilization methods,protecting the rights and interests of farmers and perfecting the supervision mechanism.System construction of our country rural idle land use should improve the system of idle land use,optimize the idle land utilization way,idle land use program,clear clear idle land utilization standards,strengthen the supervision of idle land use,safeguard the rights and interests of farmers in land use six aspects of concrete.Combined with the direction of the homestead system reform and the current obstacles to the active utilization of idle homestead,this paper puts forward some suggestions to expand the commercial use of the homestead appropriately,gradually remove the restrictions on the transfer of homestead,and strengthen the connection between the use of idle homestead.The innovation of this paper lies in that it can systematically construct the system of unused homestead utilization,which further enriches and expands the research content of homestead system.Further research will be carried out on the specific application of the legalization of the separation of the three rights for homestead to the revitalization and utilization of idle homestead,as well as the improvement of the supporting legal system for the utilization of idle homestead that meets the requirements of urban-rural integrated development. |
