| China paid great attention to the enactment and implementation of laws as early as the early days of state formation.From the time Zi Chan became the Chancellor of Zheng and forged the Book of Punishment until the end of the Qing Dynasty,the feudal rulers attached great importance to the publication and dissemination of written laws and sought to make them known to the officials and the people.The enactment of laws was the foundation,and for them to be effectively implemented,the dissemination of laws had to be strengthened.In the Ming Dynasty generation,the state attached even greater importance to the dissemination of laws.As the founding emperor of the Ming Dynasty,Zhu Yuanzhang gradually realised the importance of spreading the law to strengthen the administration of officials and to educate the people after experiencing the peasant wars at the end of the Yuan Dynasty,the corruption of officials and a series of political conflicts and struggles after the establishment of the state.In order to implement this idea and to promote a better understanding of the law among the officials and the people,so that they could know,understand and abide by the law,he introduced the system of "Preached Laws and Decrees" in the Daming Law,which established this system of law dissemination and education in the form of the fundamental law of the state,urging officials and the people to learn and master the various laws and decrees and policies of the state.The system was established in the form of the fundamental law of the state,and officials and people were urged to study and master the laws and policies of the state.In the specific regulations concerning the study of the laws and regulations,the system of Preached Laws and Decrees provided for different management measures for different audiences.Recognising that the officials were the most crucial part of maintaining the rule of the feudal state,Zhu Yuanzhang focused on the officials at all levels of the government,and made the ability to read and explain the laws an important indicator in the year-end assessment of the officials.He also recognised that the people,as the foundation of the state,were the most fundamental part of the maintenance of feudal rule,and therefore,guided by the ideas of "Putting people first" and "Integrate punishment with education",he demanded that the laws be simple and appropriate at the beginning of the formulation of the laws,and issued the He promulgated the "Direct solution of law" to help the people understand them,and the "Imperial order",which were published in China and abroad to educate the people.He also reinstated the system of Rural drinking ceremony in the countryside and added the innovative element of ’reading the law’ to it;he issued a teaching list to re-establish the social order in the countryside at the beginning of the Ming Dynasty and educate the people to obey the law.Zhu Yuanzhang drew lessons from the fall of the Yuan dynasty and drew on the experience of legal literacy activities over the ages to create the system of "Preached Laws and Decrees",with a view to making it work better.The implementation of the "Preached Laws and Decrees" system had remarkable results in the early Ming Dynasty and had a profound impact on future generations.However,the system of "Preached laws and decrees" did not last long,after the Hongwu period,the system was gradually abolished,and due to the inherent backwardness of the feudal system and the interference of imperial power in the implementation of the system,this system did not achieve the purpose of Zhu Yuanzhang’s imagination,there are obvious limitations.This paper attempts to systematically analyze the social background reasons,the implementation path and the impact of the system,which will help us to better understand the social operation of the Ming Dynasty and thus gain a more comprehensive understanding of the whole Ming Dynasty. |
