Illegal human trafficking has always existed in ancient China,and it was even more rampant in the Qing Dynasty.The illegal human trade studied in this thesis mainly refers to the behavior of abducting and abducting human beings,as well as the behavior of selling civilians as slaves,which is called human trafficking in the law of Codex of the Qing Dynasty.In the past,when scholars studied the issue of population trading in the Qing Dynasty,they often locked their research areas in the southwest region or the North China Plain,while ignoring the Shengjing area where a large number of bannermen and people lived together.This thesis focuses on judicial archives in the Manchu Heitu Archives during the Kangxi and Yongzheng periods,combined with official books such as the Law of Codex of the Qing Dynasty,Huidian Rules and other official documents,to analyze the cases of illegal human trafficking in Shengjing.The text consists of three parts:The first part: The social background of the crime of illegal human trafficking in Shengjing.Mainly using official books such as Qing Shilu to explain Shengjing’s banner people management policy,immigration policy,and the relevant conditions of Shengjing’s social population trading before entering the customs,etc.,to explore the historical origin of population trading crimes in Shengjing.The second part: Case analysis of illegal human trafficking in the Manchu Heitu Archives.According to the content of the archives,the cases of human trafficking in Shengjing are divided into four types: abduction and trafficking of women and children,slight sale of beloved as slaves,abduction and sale of other people’s slaves,and abduction for marriage and sale.What these cases have in common is that people are obtained by means of deception,temptation,or even violent robbery,and then resell them.Then analyze the various people involved in the crime of illegal human trafficking,including the identities,living conditions,and behaviors of traffickers,accomplices,intermediaries,buyers,and abducted persons.The third part: Judicial issues reflected in human trafficking cases.Focusing mainly on archival cases,it discusses the division of functions,law enforcement systems and procedures,and the principles and basis for convictions of various judicial organs in Shengjing. |
