On The Model Of Psychological Coercive Interrogation

Interrogation mode is the abstraction and summary of specific interrogation strategies,methods and processes,and it is the whole system methodology embodied by the action of interrogation mechanism on specific interrogation strategies and processes.The mode of interrogation is related to the strategy,method,mechanism,procedure and system of interrogation.To study the interrogation mode,to examine the general law of the interrogation process from an overall perspective,especially through literature investigation,concept analysis,comparative study,case analysis and other methods,to deeply study the application of psychological coercive pressure in investigative interrogation and promote the transformation of interrogation mode,which can provide new ideas for the investigation of interrogation research in China.It can also provide theoretical support for solving the problem of investigation case systematically,which has important theoretical and practical significance.By systematically combing through the research results of the psychological coercive interrogation model theory in our country,the author proposes that the psychological coercive interrogation model is that the interrogators based on the psychological state of suspects,using the pressure and coercive interrogation strategies and methods,make them change from resisting confession psychology to truthfully confessions psychology,so as to obtain the interrogation mode.It is a kind of psychological "hard interrogation".In terms of operation mechanism,it is manifested in four levels: the first is the use of psychological interrogation strategies and methods;the second is the use of pressure;the third is to force the suspect to tell the truth;the fourth is to promote the suspect to complete psychological transformation.In terms of presentation mode,psychological coercive interrogation mode is manifested as the interrogation method combining "hit" and "pull",different interrogation strategies designed with the psychological state of the criminal suspect as the target,and the interrogation process with pressure as the core layer by layer.Based on the basic assumption that investigators interrogate criminal suspects who are actually guilty,the main problems of psychological coercive interrogation mode are as follows: the lack of screening procedures for innocent people before the interrogation begins,which may include criminal suspects with minor criminal suspicion or even innocent people into the interrogation process designed for guilty suspects;In the process of interrogation,investigators continue to increase the pressure,which is easy to make innocent people make false confessions.Based on false confessions,investigators wrongly ignore important evidence.End the process of trial investigators excessive interference in the formation of confession.The root of these problems lies in the fact that the interrogators violate the temporality and dynamic characteristics of the assumption of guilt,and appear static conviction of guilt,which leads to the alienation of the objective of interrogation.There are great differences between the American psychological manipulation interrogation model and the British PEACE model in interrogation concept,interrogation process design,interrogation methods,interrogation laws and regulations.Based on the historical evolution,main contents and characteristics of these two modes,the author puts forward a path to promote the transformation of psychological compulsory interrogation mode in our country: by setting pre-interrogation standards,breaking the closure of interrogation process,implementing police vocational training and other measures to improve and optimize the current psychological compulsory interrogation mode;Taking the interrogation of specific groups as the pilot,strengthening the follow-up guarantee of laws and regulations,and promoting the overall transformation of psychological interrogation mode from compulsion to persuasion through the transformation of interrogation mechanism,interrogation methods and interrogation links.
