| Temple land has its particularity in various types of land in Ming-qing Dynasty,which is an important point to see the essence of property rights in ancient Chinese society.Since the temple land has a certain attribute of public land,its ownership of property rights cannot be as clear,stable and defined to individuals as private land.This paper draws on Zhang Xiaojun’s “compound property rights” theory.From the view of the forming process and influence of political property right,social property right and cultural property right in temple land right are discussed respectively,reveals the temple land in Yunnan region in the Ming-qing Dynasty complex compound land ownership structure.This paper argues that temple land right is a kind of compound property right.Social property right,political property right and cultural property right coexist in temple land right and constitute a compound land right structure.At the same time,this paper takes time as a clue,combined with the influence of the loss of temple land,the reform of the tax system and the policy of temple property to the temple land,analyzes the development of temple land in Ming-qing Dynasty and the dynamic change process of temple land rights in this historical period.This paper argues that since the mid-Qing Dynasty,a large number of temple land converted to private land.Affected by government policy in late-Qing Dynasty,the temple land rights transit from compound property rights dominated by social property rights,political property rights and cultural property rights to compound property rights dominated by political property rights.The study of this paper shows that the land property right in traditional society is a compound land property right structure,but political property right has always been dominant in the land property right structure. |
