Forestry is the main body and focus of ecological civilization construction,and the healthy development of forestry is of great significance to improving the ecology,improving the quality of people’s life and building a beautiful China.In recent years,China has always placed forestry construction in an important position and continuously stimulated new vitality in forestry development.However,the construction and management of forestry requires a lot of investment,In particular,social capital should be introduced in order to make the construction and operation of the forest have a continuous flow of power.The important role of forest carbon sinks as a tool for using the market mechanism,make the forest ecologicalobjectives.With the goal of "carbon neutrality and carbon peaking" proposed by China,the development of forest Carbon sinks are an important means of realizing the "double carbon" target.Therefore,in-depth research on the legal issues of forest carbon sink can provide an important theoretical basis and practical basis for forestry construction in China,ecological environment protection and building "beautiful China".A review of China’s forest carbon sequestration legal system shows that the main bodies for formulating relevant documents are the National Development and Reform Commission,the State Forestry Administration and the Ministry of Ecology and Environment,which are departmental rules at the legal level.In addition,there are local regulations and normative documents formulated by some provinces(autonomous regions and municipalities).These laws and regulations have a relatively low level of effectiveness,and there are few contents related to forest carbon sinks,and there are no special provisions on the ownership and circulation of forest carbon sinks.This has caused problems in the legal standard system of forest carbon sequestration,the trading rules of the carbon sink market,the guarantee system for forest carbon sequestration and the definition of forest carbon sequestration rights,which hinder the rapid development of China’s forest carbon sequestration projects,make the forest carbon sequestration lack due benefits,hinder the development of the carbon sequestration market,and will adversely affect the realization of the goal of "carbon neutrality and carbon peaking" in the long run.In this regard,suggestions for improving China’s forest carbon sequestration legal system include: on the basis of exploring the concept of forest carbon sequestration under the goal of "carbon neutrality",build China’s forest carbon sequestration legal system and improve the legal standard system of forest carbon sequestration,so as enlarge the scale of CCS projects and improve the veracity and reliability of CCS measurement;It is necessary to unify trading rules and strengthen the construction of legal order for carbon sink trading;Clarify the ownership of forest carbon sinks,and strengthen the rights and remedies for forest carbon sink owners;Strengthen the guarantee system for forest carbon sinks and develop forest carbon sink trading markets;International cooperation mechanisms should continue to innovate and strengthen cooperation between international forest carbon sequestration projects.In this way,we can improve China’s forest carbon sink legal system,reduce carbon sink trading costs,make the forest carbon sink trading market flourish,and help achieve the goal of "carbon neutrality".Pay attention to the protection of the overall ecological environment of forests,and maintain the healthy and sustainable development of forestry carbon sequestration.
