Since 2013,China’s economic model has slowly shifted from high-speed growth to high-quality development,and it is now in the process of optimizing the economic structure and realizing the transformation of growth momentum.This period is full of opportunities and challenges for traditional construction companies.Opportunities mean that under the guidance of the national innovation-driven development strategy and the in-depth advancement of new urbanization,there will be a new round of investment boom.Construction companies can actively participate in the construction of smart cities during the transformation of the industry,and win-win cooperation.Profit in the industry chain.The construction industry plays an important role in the construction of new urbanization.Challenges mean that the development of traditional construction companies relying on rapid expansion of scale is becoming a thing of the past,and external pressure will force traditional construction companies to transform and upgrade.Traditional construction companies,especially state-owned construction companies,will face various problems in the process of transformation and upgrading in the past development process.As a state-owned construction enterprise,XJ construction enterprise has many subsidiaries and scattered jurisdictions.In the previous years of development,it unilaterally pursued the scale and speed of development and ignored the legal risk management of the enterprise.This has led to an increase in lawsuits by the enterprise year by year,which has a serious impact.The development of the enterprise.Now,XJ construction enterprises urgently need to use limited resources to improve the level of corporate legal risk management and build a scientific corporate legal risk prevention and control system in the process of transformation and upgrading.Based on the background of the issuance of the Three-Year Action Reform Plan for State-Owned Enterprises(2020-2022),this paper studies the legal risk management of enterprises from the actual situation of XJ construction enterprises.Firstly,the brainstorming method,management interview method and flow chart method were used to analyze and identify the current legal risks of XJ Construction Enterprise.Secondly,the questionnaire method and qualitative analysis method evaluate the degree of impact of the identified legal risks on the development of enterprises.Then,using the theoretical knowledge of risk management and legal science,combined with the principle of hierarchical risk management,a risk management and control plan is proposed for the identified legal risks.Finally,according to the requirements of enterprise legal risk management,combined with the principle of continuous improvement,suggestions for the implementation of legal risks are proposed.Through the discussion in this article,it provides a complete legal risk management and control scheme for XJ construction enterprises,and also provides a reference sample for the legal risk management and control of other state-owned construction enterprises.
