Legal Risk Management Of State-owned Construction Enterprises

As China’s market economy develops,China’s construction market is also in the era of change.However the increasingly intensifying competitive environment of construction market,laggardness of legislation for the management of construction market and frequently occurrence of illegal behaviors bring severe legal risks and hidden troubles to the development of construction enterprises.Besides,the unequal market position of the concerned party of construction enterprise and the frequent intervention of the state to construction contract result in huge preventive difficulty to the prevention of legal risk of construction enterprise.Therefore,the one of enhancing the legal risk prevention mechanism of enterprise is significant to promote the state-owned construction enterprises to adapt to the market economy development and improve the core competitiveness of enterprise.Thus the theoretical cycle is needed to study the legal risk prevention theory for construction enterprise so as to provide theoretical support and guidance for the state-owned construction enterprises for the legal risk prevention.The GD Company is a developing small and medium-sized state-owned construction company.However since the intensified competitiveness between construction enterprises,its existing management level is very difficult to cope with the legal risks and thereby it has to suffer with higher legal risks.Therefore the one how to control the legal risks and guarantee the GD Company to get a sustainable development is the important working task before the corporate management.On the basis of the reasons aforesaid,we selected the current situation of legal risk prevention of GD Company as the entry points to start the research on its legal risk prevention.In this work,we relied on the current situation of legal risk of state-owned construction enterprise,combined the years’ work experience in the management position of construction enterprises,and utilized the enterprise management knowledge we learned to research the existing problems in the legal risk management of GD Company,and finally propose the suggestions capable of improving the legal risk management for the researches.In this paper,there are some innovations in research methods,research objects and research ideas.The main innovations are as follows:(1)The research of theory can not be separated from the support of practice.The research object of this paper is the work unit of the author.The measures proposed in this paper to improve the legal risk management of GD company are based on practice and combined with theory,with strong practicality.(2)GD company is a typical state-owned construction enterprise,which has certain representativeness.The measures proposed in this paper to improve the legal risk management of GD company are also of reference significance to other state-owned construction enterprises.(3)In this paper,the research ideas are relatively new.Through case analysis and comprehensive analysis,this paper analyzes the problems in legal risk management of GD company,and puts forward corresponding measures from three aspects: improving the legal risk management prevention mechanism,enhancing the awareness of legal risk prevention and control of all employees and strengthening the legal risk prevention of the whole life cycle of the project.
