Investigation On The Ecological Environment Customary Law Of The Yi Ethnic Group In Chuxiong,Yunnan

In January 2015,General Secretary Xi Jinping inspected Yunnan and put forward the strategic positioning of "strive to become the vanguard of ecological civilization construction" for Yunnan.In January 2020,General Secretary Xi Jinping visited Yunnan again and asked Yunnan to strive to continuously make new progress in building our country’s ecological civilization.The traditional legal culture of the Yi ethnic group in Chuxiong,Yunnan has a simple ecological concept,which has been formed for thousands of years and is reflected in the form of traditional customary law,and has played a positive role in practice for a long time.Under the background of "adhering to the idea that Clear waters and green mountains and unswervingly taking the road of ecological priority and green development",the ecological environment customary law in ethnic areas is one of the important norms to promote the construction of ecological civilization.Under the background of the "pluralistic integration" pattern of the Chinese nation and the construction of the rule of law with Socialism with Chinese characteristics,this paper analyzes the emergence of the ecological environment customary law of the Yi people in Chuxiong,Yunnan,in the context of the new era,sorts out its contents,governance methods and characteristics,and analyzes its realistic value,difficulties and solutions,with a view to giving full play to the ecological environment customary law of Chuxiong,Yunnan,in building a strong sense of the Volksgemeinschaft of the Chinese nation The positive role of solving ecological and environmental problems and building the rule of law in ethnic areas.The first chapter defines the relevant concepts of the research object of the article.The focus is on defining core concepts such as "Yunnan Chuxiong Yi Ethnic Group","customary law",and "ethnic ecological environment customary law",laying the foundation for further research.At the same time,explain the local location of the research sample and the research process,and explain the reasons for selecting the local location of the research sample.The second chapter focuses on the emergence,content,and governance methods of the ecological environment customary law of the Yi ethnic group in Chuxiong,Yunnan.By collecting and organizing data and relevant literature obtained through field research,the objective basis of the ecological environment customary law of the Yi ethnic group in Chuxiong,Yunnan,including ecological environment changes,and the subjective basis of religious beliefs,were analyzed;Sort out the content of the ecological and environmental customary laws of the Yi ethnic group in Chuxiong,Yunnan,including the protection of vegetation,animals,water resources,and human settlements;The summary analysis includes traditional governance methods based on religious beliefs with a focus on rewards and punishments,as well as modern governance methods based on environmental protection concepts and village regulations,analyzing their governance effectiveness,and dissecting them based on specific typical cases.The third chapter focuses on analyzing the legal relationship,characteristics,and value of the ecological environment customary law of the Yi ethnic group in Chuxiong,Yunnan.The ecological environment customary law of the Yi ethnic group in Chuxiong has three main characteristics: firstly,it reflects a simple ecological view;Secondly,it has obvious religious and regional characteristics;Thirdly,a unique system has been formed.The ecological and environmental customary law of the Yi ethnic group in Chuxiong has three values: firstly,the value of the rule of law,including legislation,law enforcement,judiciary,and compliance with the law;The second is the value of policy,which is the value of green development,rural revitalization,and building the awareness of the Chinese Volksgemeinschaft;The third is cultural value,and the ecological environment customary law of the Chuxiong Yi ethnic group provides cultural support for the ecological rule of law.The fourth chapter focuses on analyzing the difficulties faced by the ecological and environmental customary laws of the Yi ethnic group in Chuxiong,Yunnan,and the ways to solve them.The main difficulties faced are: firstly,the changes in times and population mobility have led to the discontinuation of its inheritance,as well as changes in the natural environment that have limited its value;Secondly,it has natural defects such as closed backwardness and loose complexity;Thirdly,there is a conflict between traditional ecological and environmental customary laws and modern state enacted laws in terms of application choices and content.In response to the above difficulties,solutions should be explored from three aspects: firstly,strengthening research and support for the ecological and environmental customary laws of the Yi ethnic group in Chuxiong;The second is to further leverage the ecological and environmental customary laws of the Yi ethnic group in Chuxiong in environmental governance through village regulations and agreements;The third is to promote the positive interaction between customary laws and enacted laws on the ecological environment of the Yi ethnic group in Chuxiong.
