Research On The Legal Issues Of Garbage Classification And Grid Governance

With the advent of the era of wisdom,in order to solve the dilemma of“garbage siege”in China,the successful experience of community governance——has been applied to garbage classification management,and a new model of garbage classification management has officially emerged.Garbage classification grid is the combination of the grass-roots governance mode with Chinese characteristics and modern science and technology,which realizes the precision and informatization of garbage classification and management,responds to the diversified needs of the social public services,and improves the modernization of garbage classification and management capacity and governance level.However,in the process of garbage classification and grid governance,there are some problems of practice first and legal confusion,and the relevant legal norms are only generally summarized from the principle aspect.The legal problems existing in the practice of garbage classification grid governance mainly include the lack of governance norms,the single governance subject,the unclear rights and responsibilities of grid members,the lack of coordination in the governance process,the lack of judicial relief,and the lagging supervision system.This paper sorts out the legal system involved in the grid governance of garbage classification,combined with the governance chaos existing in practice,and puts forward legal suggestions on the grid governance of garbage classification.The main contents of this article are described as follows:The first part is the basic theory of garbage classification and grid management.By analyzing the connotation,theoretical basis and practical function of grid governance of garbage classification,and studying the legal relationship of grid governance of garbage classification,it can provide a theoretical basis for solving the legal problems in grid governance of garbage classification.The second part is to investigate the legal norms and practice of garbage classification grid management.By sorting out the relevant legal norms,and analyzing the practice of Shanghai,Zhejiang,Kunming and other regions,we then find the dilemma of the application of garbage classification grid at the present stage.The third part,the existing problems of garbage classification and grid management.The existing legal issues are explained in detail,including the lack of governance norms,single governance subject,unclear rights and responsibilities of grid members,lack of coordination in the governance process,lack of judicial relief,lagging supervision system and other related legal issues.The fourth part,garbage classification grid legal management countermeasures.The legal countermeasures to improve the grid governance of garbage classification,including the formulation of special governance norms,ensuring the diversity of governance subjects,clarifying the list of rights and responsibilities of grid members,promoting the coordination of governance departments,improving the judicial relief channels,and optimizing the supervision system,etc.
