Research On Environmental Law Enforcement Issues In The Field Of Infrastructure In Tibe

In recent years,with the vigorous implementation of the "Fourteenth Five-Year Plan",China has entered the period of building a moderately prosperous society in an all-round way,and has embarked on a new journey of building a socialist modern country in an all-round way.All regions are at a critical stage of constantly improving infrastructure construction,promoting regional coordinated development,improving the level of social construction and promoting high-quality economic and social development in all regions.At the same time,China’s environmental situation is becoming more and more serious,and environmental protection and environmental governance has become an important issue in China at present.In the process of practicing ecological civilization,the power of environmental protection law enforcement,as the right to be guaranteed and enforced by the state according to law,is the key to promote the smooth implementation of Tibet’s efforts to build ecological civilization and the rule of law for environmental protection,especially in the clean-up of illegal environmental protection projects in the field of engineering construction in Tibet,It can be seen that there are different problems in the environmental law enforcement work in many links,resulting in adverse effects on the whole environment of Tibet.Therefore,it is necessary to focus on and study the environmental law enforcement work in the construction of projects in Tibet.The article first reviews and evaluates the current research situation of environmental law enforcement issues in the field of infrastructure at home and abroad,so as to determine the research ideas and directions of the paper.Secondly,it defines the relevant concepts involved,clearly defines the framework of the discourse system of this article,and at the same time combs the current situation of environmental law enforcement in China and the environmental law enforcement work in the field of infrastructure,The operation mode and relevant configuration of the environmental law enforcement authority of the environmental law enforcement department were clarified.Then,from the perspective of environmental supervision institutions,the research project was divided into three major law enforcement stages,namely,the environmental protection approval stage,the process control stage and the end treatment supervision stage.Through the analysis and summary of the main environmental law enforcement work of the environmental protection law enforcement departments at each stage,it was found that the main problems in the environmental law enforcement work in the field of infrastructure construction in Tibet were: the environmental assessment approval was not strict;The post-evaluation of the EIA report and the supervision and monitoring of the "three simultaneities" system are not in place;The grass-roots environmental protection law enforcement departments are seriously understaffed;The environmental protection law enforcement department is slack in performing its regulatory responsibilities;The way of political punishment is single;Environmental protection law enforcement departments and other law enforcement departments are not linked enough.By analyzing the causes of the above problems,the paper proposes to promote the application of comprehensive environmental law enforcement mechanism;Expand the grass-roots law enforcement team in Tibet;Strengthen the procuratorate’s legal supervision over environmental protection law enforcement departments;The establishment of grass-roots environmental protection community cooperative mechanism and other measures,in order to effectively solve the environmental law enforcement problems in the field of infrastructure construction in Tibet,put forward targeted and specific feasible suggestions,so as to further improve the level of environmental law enforcement and environmental governance capacity in this field in Tibet.
