| With the continuous increase of human exploitation of nature,many environmental problems have been frequently exposed in various regions,among which environmental accidents in the field of engineering construction in special areas such as nature reserves,scenic spots and ecological conservation areas have gradually attracted people’s attention.The Central Environmental Protection Supervision Group recently announced typical cases,many construction projects were built without approval,small construction was approved,and illegal approval problems were exposed,followed by a large number of illegal buildings were demolished,such as the overdevelopment of Changwaishan Mountain in Jinning,Kunming,which affected the integrity of the Dianchi Lake ecosystem,was forcibly demolished,the environmental resource damage caused by the overdevelopment of illegal land supply in Qinling,Shaanxi was rectified,and a company in Zhenjiang City illegally built an office building within the Yangtze River channel to change the original appearance of the river and damage the hydrological ecology of the Yangtze River.What is the reason why construction projects have repeatedly had environmental problems and have been rectified? What restricts the development of the urban environment? What is the role of environmental administrative enforcement mechanisms? This is all worth exploring and studying in depth.At present,environmental law enforcement of construction projects is mainly manifested in access,in environmental impact assessment and construction permits,layer by layer screening,while ignoring the "three simultaneous" and tracking management in the matter,and the real systematic and efficient law enforcement work is inevitable to the joint help of law enforcement system,law enforcement methods and law enforcement supervision,only by continuously standardizing and improving the environmental administrative law enforcement mechanism can we realize government management functions and protect citizens’ rights.Starting from the current situation of environmental administrative law enforcement in China,in order to improve the ability of environmental governance,it is necessary to improve urban development planning,improve the overall governance efficiency,and strengthen supervision and accountability,adhere to linkage law enforcement,improve the construction of law enforcement teams,and increase the application of modern technology,in order to break through the current dilemma of low law enforcement efficiency in the field of construction projects,and provide support for the construction of a whole-process environmental law enforcement system of "source prevention and control,process supervision,and post-event accountability".The structure of this paper is mainly divided into five parts,the first part is the definition of relevant concepts and theoretical foundations;The second part is an overview of the environmental administrative law enforcement mechanism for construction projects in China;The third part is the relevant case analysis and existing problems;The fourth part is the analysis of the causes of the problem;The fifth part is to improve the environmental administrative law enforcement suggestions for China’s construction projects. |
