Study On The Problem And Countermeasure Of Guarantee System Of Environmental Administrative Law Enforcement In County Territory

Good ecological environment is an indispensable condition to the human survival and development. Nowadays, environment pollution and destruction has become one of the major social problems over the world. Environmental administrative law enforcement is law enforcement activity that environmental management agencies follow legal procedures and take legal measures to ensure all the environmental laws and regulations to be strictly carried out. It also include the necessary penalties for environmental violations.It’s an important part of the works of environmental protection that effectively carried out by our government.In recent years, county environmental administrative law enforcement has made a lot of achievements. But there are also a lot of problems.For example, some behaviors of discharging pollutants secretly acted by the enterprises violating environmental protection laws are still not effectively curbed and environmental pollution incidents occur frequently.Generally speaking, the environmental situation is still very serious in our country at presentThere is a big gap between the environmental governance effect and people’s expectation.The reason leading to this problem of course is various.But the imperfect environmental administrative law enforcement guarantee system, which leading to the lack of environmental law enforcement capacity and the inefficiency of the implementation of environmental laws and regulations, must be one of the important reasons.And this problem is more concentrated and outstanding in the county environmental administrative law enforcement activities.Therefore, how to improve the county environmental administrative law enforcement guarantee system and effectively promote the construction of county environmental law enforcement is a subject that needs to be discussed urgently.Taking the city of Macheng in Hubei Province as the case, this paper uses administration management, administrative law, environmental science and other disciplines, to analyze the county environmental administrative law enforcement guarantee system. And elaborates its fundamental connotation, explores significance of improvement of the county environmental administrative law enforcement guarantee system. Then through empirical study analysis the present situation of county environmental administrative law enforcement and the problems existing in the guarantee system. At last, proposes the corresponding measures. This paper is made of four parts:The introduction is the first part of this paper.It briefly explains the reasons of choosing this topic and the research significance. It combs and induces some related researches of domestic and foreign,introducing the ideas of the research and the main content of this paper.The second part states the basic concepts and theoretical basis of the county environmental administrative law enforcement guarantee system.This part is make up of two sections. The first section states the meaning of administrative law enforcement, environmental administrative law enforcement,administrative law enforcement guarantee and the environmental administrative law enforcement guarantee.The second section analysis realistic significance of improving environmental administrative law enforcement guarantee system, which mainly embodied in three aspects:firstly, it is beneficial to improve the ability of law enforcement of the subject, and ensure the effeciency of environmental law enforcement; secondly, it will help to improve the level of environmental management, then promote the sustainable development of economy and society; thirdly,it can help to accelerate the pace of construction of law-based government.The third part is about the analysis of the administrative law enforcement and guarantee system of Macheng.This part,first, introduces the development status of environmental administrative law enforcement in Macheng and the achieved results and the existed problems.The fourth part focus on the analysis of the poor performance of administrative law enforcement guarantee system of Macheng.It includes the lower independence of law enforcement agencies,law enforcement is not enough,management system is not smooth,legal system is not sound,supervision mechanism has a defect,law enforcement’s team construction lags behind,lack of funding,and the law enforcement environment is not good.The fifth part is about that how to perfect the guarantee system of county environmental administrative law enforcement.It needs to improve the county environmental administrative law enforcement guarantee system from the following aspects:Firstly,deepen the reform of environmental administrative law enforcement system. Secondly, improve the legal basis of environmental administrative law enforcement. Thirdly, deepen the supervision of environmental administrative law enforcement.Fourth,strengthen the team construction. Fifth, improve the scientific and reasonable guarantee mechanism for the environmental administrative law enforcement. Last, to create a good atmosphere for environmental law enforcement.
