Research On Problems And Countermeasures Of Ecological Environmental Law Enforcement In Guanghan City

The "modernization of harmonious coexistence between man and nature" is an illustration of the Chinese style of modernization.The report to the 20 th National Congress of the Communist Party of China laid out the strategic task of building a new era of ecological civilization in China,outlined the vision of harmonious coexistence between man and nature,and pointed out the direction of green development.In the prevention and control of environmental pollution,we need to strengthen the iron defense of environmental protection and fight the three battles of blue sky,clear water and clean land.Law enforcement of the ecological environment is a powerful weapon in the front line of environmental protection at the community level.The ecological environment department of Guanghan City strictly implements various functions and responsibilities,overcoming difficulties in environmental law enforcement and seeking truth and pragmatism,but there is still a certain distance from people’s expectations.Therefore,it is of great practical significance to study the problems and countermeasures of ecological environmental law enforcement in Guanghan City and improve the efficiency of environmental law enforcement.The research content of this paper is the problems and countermeasures of ecological environment law enforcement in Guanghan City.The problems existing in ecological environment law enforcement work in Guanghan city are taken as the breakthrough point to analyze the reasons affecting the efficiency of environmental law enforcement in Guanghan City and put forward feasible and suitable countermeasures.The author conducted special interviews with officials from different positions focusing on law enforcement issues,conducted questionnaire surveys,and analyzed the situation of law enforcement teams.Based on the theoretical framework of the theory of administration according to law,the theory of street bureaucrats,the author concluded that the problems existing in ecological environment law enforcement in Guanghan City are mainly as follows: "Disorderly and polluting" enterprises are difficult to treat,the powers and responsibilities of law enforcement departments are unclear,the deterrence of law enforcement is not high,and the applicability of environmental protection laws in administrative penalties is confused.Based on the survey and interviews,the author concludes that the causes of these problems can be divided into three levels: system,behavior and organization.The main reasons are: case-handling procedures are not standardized,accountability and reward and punishment mechanisms are not perfect,the revision of supporting laws and regulations on environmental protection is delayed,environmental law enforcement capacity is broken,local factors interfered with law enforcement,and personnel organizational structure is unbalanced.By learning the advanced experience of environmental law enforcement at home and abroad,the author puts forward three countermeasures on the system,behavior and organization of environmental law enforcement in Guanghan City: strict project examination and approval,compacting the responsibility of local environmental committee,implementing the accountability mode of "the Party and the government share the responsibility",promoting the coordination of law enforcement units and so on.It is expected that through the above countermeasures and suggestions to improve the efficiency of Guanghan City ecological environment law enforcement,create a capable,successful,warm environmental law enforcement team,with excellent environmental governance results to win public praise,but also for our ecological environment law enforcement work to provide a grassroots sample.
