| In recent years,medical and health care has been developing continuously.Along with the increasingly superior medical environment and facilitation of medical technology,the disposal of medical waste has gradually become the focus of attention.Compared with developed countries,the relevant laws and regulations of medical waste disposal have been introduced late,and the legal system still has imperfections.Coupled with the emergence of public emergencies such as the novel coronavirus outbreak,the current stage is faced with the contradiction between the incomplete legal regulation of medical waste disposal and the urgent need of the society to improve the disposal of medical waste as soon as possible.In the background of this era,the author analyzes the existing problems in the legal regulation of medical waste disposal,and dialectically combines the relevant foreign systems to give corresponding countermeasures.It is not only the key to improve the legal system to promote the rule of law,but also a key part of ensuring the governance capacity and the modernization of the governance system.This paper is divided into five parts,the first part is the introduction,clarify the topic selection background and significance,then through domestic and foreign medical waste disposal frontier research,find out the research direction of this problem from two levels of law and practice.The second part is an overview of the legal regulations on medical waste disposal.It is necessary to clear the basic concepts and basic knowledge and comb the aspects of related concepts and characteristics to study the medical waste disposal system.The third part,based on the empirical research,firstly summarizes the legislative process and current system of medical waste disposal in our country.Secondly,it introduces an empirical case of medical waste disposal pollution to analyze the current situation of disposal under the current legal regulations.On this basis,it concludes that there are three problems in the current legal regulations of medical waste disposal,such as incomplete legal regulations,incomplete system and inadequate supervision.The fourth part provides reference for foreign legal regulations,summarizes the experience of legal regulations of medical waste disposal in America and Japan,and provides the basis for the complete legal system of medical waste disposal in our country.The fifth part of our national conditions,from the medical waste disposal laws and regulations,the complement of medical waste disposal system content,improve the medical waste supervision system and tracking mechanism of the three aspects of the specific proposals. |
