Legal Regulation On Pollution Prevention And Control Of Groundwater In China

Groundwater is not only the natural resource for ecological balance,but also the key for national economic development,making it a vital role in China’s economic and social sustainable development.However,groundwater pollution has become increasingly serious due to the rapid development of economy,the Industrialization and the urbanization.The influence of human’s activeties on groundwater has already exceeded the purifying capacity of the groundwater environment itself,resulting in degeneration of groundwater ecological environment.Groundwater pollution,which also called “invisible pollution”,can not inform the environment pollution to human in a dominant way.It is difficult for human beings to realize its harm on social development and human health as groundwater has such a high degree of concealment.In recent years,The increase of groundwater pollution affairs and the serious consequences derived from these pollution have aroused great concern of government and the public.In 2011,the Prevention And Control Plan Of National Groundwater Pollution(2011-2020),which approved by the State Council put forward the main tasks and objectivesFor the control and prevention of groundwater pollution.In this paper,we have analyzed the legislation status about groundwater pollution prevention and control in China.Recommendations for the improvement of China’s groundwater pollution prevention system on the basis of experience from other areas and overseas developed countries(regions) have been proposed.This paper contains five parts.The introduction mainly describes the research background,purpose and significance for underground water protection,as well as the research progress in China and other areas.In the second part,basic problems in groundwater pollution,which include the definition of groundwater pollution,the characteristics and main source of groundwater pollution in legal regulation.The third part firstly analyzes the current situation and problems of groundwater pollution prevention legal system in China,mainly focusing on the current situation of groundwater pollution Preventing and controlling groundwater pollution from the following 4 aspects,constitution,laws,regulations and technical specification.After that,the practical legislative shortcomings,which include the problems of the laws in prevent and control groundwater pollution,are pointed out.The fourth part introduces the legal system and experience of Taiwan and other areas in preventing and controlling groundwater pollution.,so as to benefit the improvement of the law system for the prevent and control of groundwater pollution in our country.The main aim of the last part is to mend the nomothetic mode,criterion,judicial system and legal responsibility:base on the principles of groundwater risk prevention,sustainable development and public participation,emphasis on improving the judicial system for preventing and remediating groundwater pollution,and strengthen the legal responsibility of groundwater pollution.
