| The issue of climate change poses a serious challenge to human society.On March 4,2020,the European Commission adopted a legislative proposal for the European Climate Law,which sets the EU’s goal of achieving climate neutrality by 2050.The law comes into effect on July 29,2021.As part of the "European Green Deal",the "European Climate Law" broke the EU’s previous decentralized legislative model,thus forming a situation in which decentralized and specialized legislation coexisted.The European Climate Law demonstrates its advantages in terms of climate goals,legal hierarchy and public participation,consolidating the EU’s position as an international leader in addressing climate change.Since President Xi Jinping proposed the goal of carbon peaking and carbon neutrality in September 2020,China has also faced the pressure of carbon emissions.Through the study of "European Climate Law",the advantages and disadvantages can be analyzed and summarized,which can provide new ideas for China’s actions to deal with climate change.As a major emitter of greenhouse gases,China should formulate special laws to address climate change as soon as possible.Actively enacting legislation to address climate change can not only demonstrate China’s determination to participate in climate change control from a legal perspective,but also make up for the insufficiency of existing laws and promote domestic response to climate change.The work is carried out in an orderly manner.This paper is divided into four chapters,the first chapter introduces the legislative background of "European Climate Law".Since the 2000 s,the EU has substantially expanded its climate change policy,expanding its economic interests and introducing an emissions trading system.The release of the European Green Deal also paved the way for the subsequent introduction of the European Climate Law.The framework law,the European Climate Law,was developed with the full support of various EU policies.The second chapter analyzes the specific rules of "European Climate Law".Although the content is relatively brief,the European Climate Law has the advantages of a novel legislative model,ambitious climate goals,high legal level,and promotion of public participation in climate governance.Of course,the law still has shortcomings,such as unclear target system and emission reduction.The path faces challenges.By studying the specific content of "European Climate Law",it has paved the way for Chapter Four to provide experience in China’s work on climate change.The third chapter studies the current situation of China’s climate change legislation.This paper analyzes Chinese existing regulations on climate change,including China’s legislative progress in adapting to climate change and efforts to mitigate climate change,and finds deficiencies in domestic response to climate change,mainly including four aspects,namely,the uncertainty of legal principles,lack of specific legislation to address climate change,insufficient public participation,and insufficient international cooperation.Chapter 4 provides suggestions for China’s work on climate change,including the implementation of the principles of climate change legislation,the formulation of a special "Climate Change Law",and the establishment of climate change laws when necessary,enhancing public participation and strengthening international cooperation. |
