On The Involvement Of Judicial Social Work In The Investigation Of Juvenile Delinquency,A Study Of Procedure From The Perspective Of Ecosystem Theory

The study of juvenile's criminal motivation is of great significance to crime prevention,conviction and sentencing,and correction and education.Social investigation almost runs through the whole juvenile judicial process.At present,the research on the motive of juvenile delinquency in China is a blind area for social investigation,which is hardly involved.The motive of crime is the reason behind the study of criminal behavior,and the mainstream view admits that criminal behavior cannot be separated from the social environment and should be analyzed and judged in the social environment,which is just in line with the ecosystem theory of social work.Therefore,social investigation is bound to become the necessity of the study of criminal motivation.The main problem of this paper is the procedure setting of social work involving in the investigation of juvenile criminal motivation from the perspective of ecosystem theory.Ecosystem theory emphasizes the interaction between individual behavior and social environment,and requires the understanding of individual behavior in social environment.The systematic and relational principles of ecosystem theory also require that individual behavior should not be analyzed in isolation,but should be placed in the ecosystem and look for the interaction between multiple elements.The principle of subjectivity of ecosystem theory requires that the principle of maximizing the interests of minors should be followed in the practice of social investigation.In this paper,literature and comparative methods are used to sort out and compare the situation of domestic and foreign minors' social investigation.From the perspective of ecosystem theory,the problems and deficiencies of domestic minors' social investigation work and procedures are analyzed.Then,under the guidance of the concept of ecosystem,and drawing on the experience of other countries,the procedure of social work involving in the investigation of minors' criminal motivation is set up.Finally,by using the method of empirical analysis,this paper makes a practical exploration of the established procedure.From theory and practice,it is an ideal choice for social work to intervene in the social investigation of minors.Ecosystem theory is the basic theory of social work,which is in the same line with "human being in the situation".It emphasizes the influence of environment on individual behavior and emphasizes the method of understanding individual behavior in ecosystem environment.The social investigation procedure from the perspective of ecosystem theory follows the basic principles of systematization,relationship and subjectivity,and meets the internal requirements of scientificity,neutrality,fairness,professionalism and comprehensiveness.The high agreement between the concept of ecosystem and the study of criminal motivation makes the study of social work involved in the investigation procedure of juvenile criminal motivation scientific and reasonable.The study of social work's involvement in criminal motivation has been proved theoretically,and with the social work's continuous involvement in juvenile social investigation,the involvement of social work in juvenile criminal motivation investigation will become a trend.
