On The Influence Of The Function Of The People's Court On The Grass-roots Social Governance

China is in a transitional period of the sharp increase both in the quantity and difficulty of cases.The former social governance system has led to the low efficiency of governance,the proliferation of cases makes it difficult for the limited judicial resources to meet the beyond-limit judicial demand,and the national courts have the problems of “low litigation efficiency” and “difficult execution”.The People's Court,which is rooted in the public and has been following the current situation to change the focus of its work to meet the needs of society,is in the frontier of resolving social conflicts and maintaining social stability to bridge the gaps between the court and the public.The participation of the People's Court in the grass-roots social governance is conducive to the improvement of the construction level of the rule of law in the governance mechanism.However,with the emergence of the difficulties in the governance of the grass-roots society,the function of the court has encountered difficulties.It is urgent to change the development path of the court from the system level and actively promote the court to participate in the grass-roots social governance.As the “experimental field” of judicial system reform,strengthening the work of the People's Court is an inevitable requirement of building a harmonious society and a country ruled by law.During the construction of diversified dispute resolution mechanism,we should deeply analyze the dispute resolution function of the court to ensure that it can adapt to the social situation.The function of the People's Court discussed in this paper exerts an influence on the social governance at the grass-roots level and is beneficial to the improvement of the system for the construction of the social governance at the grass-roots level,it plays a vital role in the legalization of grass-roots social governance.This paper focuses on the influence of the function of the People's Court on the social governance at the grass-roots level.It is divided into four parts:The first part analyzes the function of the People's Court,explores the basic unit social governance and clarifies the theory definition.It expounds the functional connotation of the People's Court,details the functional orientation and changes of the People's Court in different historical periods,clarifies the meanings of governance and social governance,and defines the basic-level social governance.The second part observes the actual situation of the function of the People's Court.From the empirical point of view,this paper briefly introduces the situation of the sample counties,and probes into the distribution,operation and cultural details of mediation of the courts.The necessity and feasibility of the court's participation in grass-roots social governance through authentic cases.Taking the quantity of public security as the reference,the aim is to solve the disputes.Therefore,the influence of the big court mediation is clear,and the important value of the court in the current social governance is affirmed.The third part explains the real predicament of the trial and non-trial functions of the People's Court in the process of participating in the grass-roots social governance.Based on the subjective and objective clues,this paper analyzes the causes of the predicament of the inadequate participation of the judiciary in the governance of the grass-roots society.The fourth part bases on the actual situation to deduce the logic train of thought of the court transformation and clear up the basic unit social governance structure.It describes the governance pattern of multiple participation and social coordination,outlines the direction of the construction of the People's Court embedded in the comprehensive governance system,and finally explores the construction of a comprehensive governance mechanism with the court as the core.
