| At present,China’s economic and social development has entered a new stage,and social contradictions have taken on new characteristics.With the development of democracy and the rule of law,citizens’ awareness of rights and legal awareness has been continuously enhanced.In the economic and social transition,a large number of conflicts of interest and conflicts have entered the judicial field in the form of litigation.Changes in the judicial environment will inevitably put forward new requirements for judicial work,and the case registration system and the reform of the judicial system have been carried out in courts across the country.As the most extreme unit in the basic judicial system,the people’s court needs to pay attention and think over what changes have taken place,how the function is running,what problems still exist and how to improve the function of the people’s court in this series of reforms involving the social environment and its own system.Based on this,this paper takes the people’s court of Y town in the mountainous area of western Hubei as the research sample,reveals the development and function operation of the people’s court in the mountainous area of western Hubei through a comprehensive and concrete analysis,finds out the problems existing in the process of function operation,and puts forward relevant suggestions for improvement.In addition to the introduction of the first chapter,this paper is mainly divided into the following parts:The second chapter describes the basic situation of the people’s court in Y town.The people’s court in Y town belongs to the people’s court in the mountainous area.The development of the people’s court in Y market town is relatively rapid,the population is dense,and the economic development is diversified.The basic construction of the People’s Court in Y Town basically meets the trial needs.After the reform of the judicial system,the judges of the People’s Court in Y Town have basically realized normalization,specialization and elitism.The large turnover of the people’s court in Y Town is not conducive to the establishment of the trial team.The third chapter introduces the function operation of the People’s Court in Y Town,including the function of adjudication and participation in grass-roots social governance.First of all,the trial function of the People’s Court in Y Town is running.Through the analysis of the case acceptance,it can be seen that the total number of disputes is on the rise,and the types of disputes are closely related to the local economic development.The case registration system has not been fully implemented in the people’s court of Y town;The service procedure mainly introduces the service method of the people’s court in Y town,and points out that the application of electronic service has effectively alleviated the "difficult service" phenomenon at the grassroots level.The procedure of case division mainly introduces the implementation of the separation system of simple and complicated cases in the people’s court of Y town.In the aspect of dispute handling,it is found that the younger judges are different from the older judges in judicial concept,case handling experience and grass-roots social relations through the comparison between the older judges and the younger judges in handling cases.Secondly,the People’s Court of Y Town participates in the operation of rural governance functions.Through the introduction,it can be seen that the People’s Court of Y Town plays an important role in building a grassroots social governance system led by Party building after 2020,and its participation and participation ability have been enhanced.The fourth chapter points out the problems existing in the function operation of the people’s court in Y town and analyzes the causes,mainly from the four aspects of fuzzy function positioning,the trial function needs to be improved,the grassroots social governance ability needs to be improved,and the lack of human and material resources.The fifth chapter puts forward the path to improve the function operation of the township people’s courts represented by Y town.First,make clear the function positioning of the township people’s law,adhere to the "dual convenience principle" basis unchanged,the local judiciary is the main method to resolve disputes,and the standard judiciary is the secondary one.The people’s court is the main body to guarantee the rule of law of grass-roots social governance.Second,improve the operation of the trial function of the people’s court from the aspects of filing a case,serving the case and dividing the case;Third,take advantage of the rule of law to participate in rural governance through multiple channels;Fourth,from the human and material resources to ensure the functional operation of the township people’s courts.The sixth chapter induces and summarizes the township people’s court in the process of Chinese characteristic socialist road development significance,the township people’s court should adhere to local justice,the rule of law talents training suited to the township people’s court,the township people’s court on the trial function,on the basis of improving dispute resolution ability,highlight its participation grassroots social governance ability. |
