Research On The Legislation Of Nature Reserves In My Country

At present,China needs to establish a natural protected area system with national parks as the main body and improve the problemsin the protection and management of natural protected areas,which cannot be guaranteed without the rule of law.In addition to creating favorable conditions for the formulation of the Protected Natural Areas Law through the reform and policy orientation of ecological civilization,special legislation on protected natural areas also aims to make up for the legislative gap of the system of protected natural areas lacking a superior law and a basic law.The existing laws and regulations of protected natural areas have played an important role in the establishment and management of protected natural areas in China in a certain period,but the existing problems show that the relevant laws of protected natural areas are not suitable for the management needs of protected natural areas in China.Based on China's policy orientation and practical needs,it is an inevitable trend to make special legislation on protected natural areas.The main body of this paper is divided into four chapters to discuss different aspects of legislation on protected natural areas in China:The first chapter is an overview of China's natural protected area system.First of all,on the basis of defining the concept of natural protected area,and through the discrimination and analysis of the similar concept with natural protected area,to determine the object of study and the scope of discussion.Secondly,it introduces the types and construction status of China's protected natural areas,and grasps the current development status of China's protected natural areas.Finally,sustainable development theory,repeated game theory and ecology theory are used as the theoretical support for the legislation of protected natural areas in China.The second chapter summarizes the status quo and existing problems of China's protected natural areas legislation.With different types of natural protected area in our country the important legislation as the research objec t,from the aspect of our nature reserve of national legislation and local legislation level summarize our natural protected area legislation characteristics,analysis our country existing natural protected area insufficient legislation has the legislative status is low,the legislative model,legislative purpose and legislative idea lag,and the problem of imperfect legislation.The third chapter investigates the legislation and management system of protected area in the United States and India,and draws on the useful experience of foreign protected areas.The United States and India protection according to its own actual situation,formation of the distinctive natural reserve legislation system,attaches great importance to the legislation of nature reserve and management in the process of public participation,through a variety of activities in the form of the public understanding of natural protected area propaganda education work,and actively guide the community residents to participate in the protected area management practices.In addition to referring to the useful experience of protected area legislation and management,the key is to actively explore the construction of our own protected area legislation system and protection management path.The fourth chapter mainly aims at the problems in the legislation and practice of protected areas in our country and puts forward some suggestions to improve the legislation of protected areas in our country.First,we should improve the legislative status of protected natural areas,formulate basic laws,policies and laws on protected natural areas,and clarify the legislative principles on protected natural areas.Second,it is suggested to adopt"comprehensive framework legislation mode" to improve the legislation system of protected natural areas.Thirdly,we should adjust the legislative purposes and ideas of the protected natural areas and pay attention to the overall protection of the protected natural areas.Fourth,the legislative content of protected natural areas should be improved,including clarifying the rights and obligations of relevant subjects such as protected natural areas,reforming the management system of protected natural areas,and improving the basic legal system of protected natural areas.
