| The development of China’s New Format Economy has given birth to new forms of employment.Internet platforms have become the new type of labor concentration area.While the development of new business formats eases the pressure on the job market,it also brings new challenges to the protection of workers’ rights and interests.In the New Format,Flexible practitioners cannot establish labor relations with platform companies or third-party companies(labor outsourcing companies).And basic labor rights are threatened-It is difficult to apply the traditional labor relationship establishment standards between flexible practitioners and platform companies in New Format;Workers lack basic guarantees such as social insurance;Their lives and property safety are threatened;Their rights to rest and employment equality are violated;And their career advancement opportunities are potentially deprived.And their lack effective Rights protection channels and rights protection assistance mechanisms...The Conflict of Labor Relations in New Format begins to develop towards the direction of dominance.In recent years,government and scholars in related fields have carried out research on the labor rights and interests of flexible employment groups in new types of employment,and put forward many constructive suggestions to solve the problems,which that is to a certain extent alleviated the contradictions between the two sides of new types of labor relations.Based on the current economic development status of the New Format and the growing trend of flexible practitioners in the New Format,and the increasingly urgent demand for labor rights,the research is carried out in this thesis.Based on the theory of labor relations,Effective Contract Theory and Hicks Paradox,this paper analyzes the employment status,labor relations problems and their causes by using literature analysis,questionnaire survey and statistical analysis.Further explore effective ways to alleviate the labor contradictions between the flexible practitioners and employers and build a harmonious labor relationship in the new business types.Specifically,the first chapter mainly introduces the relevant social and policy background,discusses the significance of the research topic in theory and reality,combs the current situation of the research objects of the thesis in some domestic and foreign documents,and considers the research methods and general ideas of the thesis.Pave the way for follow-up research.The second chapter defines the conceptual definition of the main research problem objects,expounds the theoretical basis of the thesis,including labor relation theory,effective contract theory and Hicks paradox.The third chapter mainly elaborates and analyzes the current situation and trend of the research subject’s employment environment development,the research subject’s basic situation and employment status,and the current situation of labor relations with platform companies,laying the foundation for the following problem analysis and suggestions.The fourth chapter is to sort out and analyze the problems reflected,mainly from the legal system level,the labor union construction level,the platform company and the practitioners themselves.The fifth chapter is based on the third and fourth chapters,and proposes reform suggestions for the reflected phenomena and problems.The sixth chapter is the final summary part,mainly reflecting and summarizing the above-mentioned research content,and looking forward to the development and future of the research object.This paper holds that the construction of new forms of harmonious labor relations needs to jump out of the traditional labor relations thinking,should speed up the improvement of labor laws,innovation of labor relations mechanism,social insurance system and give full play to the coordination ability of trade union organizations.It is hoped that this study can provide beneficial help to the construction of harmonious labor relations in the new form of business,and that the new economic model can continue to create achievements for the development of our country’s economy. |
