Investigation And Research On The Reform Of Litigation Source Governance In Grassroots Court ——By Taking The People’s Court Of H County,Guizhou Province As An Example

Since 2002,the Supreme People’s Court has begun to revive litigation mediation and actively promote the socialization of mediation.In 2016,the two-level people’s courts in Chengdu took the lead in proposing the concept of "source of litigation governance",and carried out the management of litigation sources in the region.The reform has achieved very good results,providing a new idea for solving the contradiction of "there are too many cases and few cases" in the courts in the era of "litigation explosion".Based on this,in February 2019,the Supreme People’s Court clearly stated in the "Opinions on Deepening the Comprehensive and Supporting Reform of the Judicial System of the People’s Courts-The Fifth Five-Year Reform Outline of the People’s Courts（2019-2023）" that the governance of litigation sources should be regarded as the deepening of diversified disputes.It is an important measure for the reform of the settlement mechanism,and it is gradually promoted across the country.On February 19,2021,the 18 th meeting of the Central Comprehensive Deepening Reform Committee reviewed and approved the "Opinions on Strengthening the Governance of the Source of Complaints and Promoting the Resolution of the Sources of Contradictions and Disputes",emphasizing that the construction of the rule of law should not only focus on the end,cure the disease,but also pay attention to it.Front end,cure disease.The party and the state have pointed out the direction for the nationwide reform of litigation source governance,and the forefront of litigation source governance is at the grass-roots people’s courts.Compared with economically developed areas,western ethnic areas face more difficulties.The author summarizes the advanced experience and inadequacies of litigation source governance in this region through the relevant research on the H County Basic People’s Court in Guizhou Province,and tries to propose solutions,hoping to carry out the work for the H County People’s Court and the basic people’s courts in other regions.It provides a useful reference for the governance of the source of complaints.This paper is divided into four parts,the first part is the introduction,including the reason and significance of the topic,the current situation of domestic research,the research process and methods.The second part mainly discusses the investigation of H County People’s Court’s participation in litigation source governance.It involves four aspects: the background of H County People’s Court’s participation in litigation source governance,the existing multi-dispute resolution system,the measures to participate in litigation source governance and the results achieved.Among them,the H County People’s Court’s participation in litigation source governance reform mainly includes: 1..Promote the institutionalized construction of litigation source governance;2.Promote the formation of a diverse dispute resolution pattern in the region;3.Actively promote the "sub-adjustment and adjudication" of cases.In terms of achieving results,the active role of mediation organizations in resolving disputes before litigation is reflected in the intuitive way of charts with the help of the people’s courts in recent years.The third part,based on the research materials,summarizes the problems existing in the H County People’s Court’s participation in the reform of litigation source governance,including the coordination between the case registration system and the litigation source governance,the assessment and supervision mechanism needs to be improved,and the trial auxiliary talents Team building is faced with four problems: difficulties and insufficient integration of multiple dispute resolution forces.In response to these problems,the author puts forward four perfect paths for the H County People’s Court to participate in the reform of litigation source governance in the fourth part of the article: grasp the underlying logic of the case registration system and litigation source governance,improve the supporting assessment and supervision mechanism for litigation source governance,strengthen trial Assisting the construction of talent teams,integrating multiple dispute resolution forces in the governance of litigation sources,etc.
