Study On The Legal Protection Issues Of Self-employment Of Chinese Retired Soldiers

"The soldiers,the great things of the country",the army is the national security machine,the rock of social stability.Judging from the current trend of national defense and military reform,the simple and simple administration is the main direction,and self-employment will be the main way for future military personnel to retire.Retired military personnel choose their own jobs,which means that the military relies on the state to support employment policies to achieve self-employment after retiring from service."Retirement" involves the formation of the military,the stability of the military,and the survival of the military after retirement.Retired military security work includes economic compensation,employment support,housing and medical care,military resettlement,etc.,but the most prominent contradiction is employment security.Therefore,we must explore a set of legal security system for self-employed soldiers in China,and position the function of the system,focusing on the legitimacy and necessity of the legal guarantee for self-employment of veterans.First of all,the jurisprudence and legal basis of the self-employment guarantee for veterans are analyzed.From the theoretical perspectives of basic rights theory,social security theory,and administrative compensation theory,the paper justifies the legitimacy and rationality of the special help of retired military personnel,and sorts out the current laws and regulations concerning the employment security of retired military personnel,and understands the legislative status of the retired military personnel in China.,the overall grasp of the existing legal system.Then from the perspective of the combination of theory and practice,the interview and investigation methods are used to comprehensively and systematically understand the status quo and prevailing outstanding problems of the self-employment security of veterans.Then,through the research on the legal system of employment security for veterans in developed countries under the rule of law,combined with China’s local innovative self-employment policy,it sums up the useful experience of retired military security legislation and self-employment measures in line with China’s national conditions.Finally,it discusses the improvement of the legal security system for self-employment of retired military personnel in China,constructs the legal system framework for enhancing the social status and respect of retired military personnel,analyzes the legal principles of state support for self-employment,and designs the legal system for self-employment security of retired military personnel.To achieve the legal system of retired military security,and other military laws and regulations,local regulations constitute a system of mutual and organic coordination.It also puts forward specific countermeasures from the aspects of economic compensation,employment support,academic education and rights relief enjoyed by retired military personnel,and realizes the state’s support to guarantee the self-employment of veterans.In short,we must earnestly safeguard the legal rights of self-employed people in the retired military.Retired military personnel choose their own jobs and legislate first.This is the embodiment of the state power operation and the will of the state.The work of veterans is more standardized,fair and just because of the unity of the will of the state.This is also the embodiment of the basic principles of ruling the country according to law.
