Research On The Legislation On Rural Poverty Alleviation In China

Rural poverty alleviation in China has experienced multiple development stages.Among them,the stage of targeted poverty alleviation has made great achievements,which has enabled China to possess the ability to eradicate absolute poverty and enter the moderately prosperous society in all respects in 2020.In the resolution for The Fourth Plenary Session of the 19 th Central Committee of the Communist Party of China in 2019,the Party and government proposed for the first time that we should establish a long-term mechanism on rural poverty alleviation to settle the problem of relative poverty that will exist for quite a long time.In face of the new poverty situation,securing the long-term operation of rural poverty alleviation will become the priority for rural poverty alleviation in the future and it is imperative to settle the problem of rural poverty alleviation through laws.Based on sorting out China’s work experience in rural poverty alleviation,the thesis summarizes the important theoretical connotations of targeted poverty alleviation,determines the core concepts in China’s poverty alleviation,formalize them with laws so that they remain stable on a long-term basis,and can be smoothly implemented under the protection of laws.Through sorting out the issue of rural poverty alleviation in China,this thesis summarizes major legal issues influencing the effects of poverty alleviation and proposes the following legal suggestions based on overseas legislation experience in poverty alleviation: Firstly,we should insist on updating legislation thoughts and upholding the dominant position of poor population in rural poverty alleviation under the premise of targeted poverty alleviation and targeted measures.Secondly,we should perfect China’s rural poverty alleviation legislation system by formulating China’s rural poverty alleviation programmatic laws,perfecting rural poverty alleviation social security legal system,strengthening poverty alleviation capital supervision,constructing through legislation poverty alleviation incentive system with the participation of multiple entities,and taking local rural poverty alleviation development regulations as the supplementary legislation.Thirdly,we should focus on such problems as ambiguous distribution of affairs,rights and liabilities and the lack of accountability mechanism in the process of power operation for China’s rural poverty alleviation and standardize the operation of power operation in rural poverty alleviation to secure the smooth progress of rural poverty alleviation.Finally,the thesis places special emphasis on the right relief for poverty subjects to ensure that their legitimate rights and interests will not be infringed upon.
