Dilemma And Countermeasures Of Law Enforcement For Illegal Constructions Governance

In recent years,with the advancement of urban-rural integration,the pace of urban and rural construction has been accelerated,and the scale and quantity of illegal construction have increased rapidly.The emergence of a large number of illegal construction has seriously hindered the planning and layout of urban and rural construction.It not only occupies and wastes land and space resources,but also affects the overall image of the city,and even threatens public security and interests.Illegal construction has become a "cancer" seriously affecting the sustainable development of cities.At present,in the governance of illegal construction,many cities are facing some universal problems and difficulties.In legislation,the definition of illegal construction is vague,and the subject of law enforcement is not clear.In law enforcement,violence against the law occurs frequently;the enforcement procedure is complex,the law enforcement cycle is long,and the law enforcement efficiency is low;the law enforcement procedure is not standardized,which damages the legitimate rights and interests of the counterpart and affects the credibility of law enforcement agencies.This paper analyzes and studies the governance of illegal construction from the perspective of administrative law.First of all,combining with the relevant laws and regulations and referring to the views of scholars,this paper combs and defines the concept and identification standards of illegal construction.Secondly,the current situation of illegal construction is analyzed.Then it analyzes the difficulties and difficulties in the governance of illegal construction.On this basis,this paper compares and analyzes the current situation of illegal construction at home and abroad,and with reference to the experience of domestic and foreign governance of illegal construction,puts forward countermeasures and suggestions to solve the problems of illegal construction governance from the aspects of improving legal system,optimizing law enforcement procedures,standardizing administrative acts,and improving rights and interests relief.In dealing with the problem of illegal construction,we should not only "treat both the symptoms and the root causes",but also "promote both dredging and blocking".We should not only improve the legalsystem,but also follow up the governance concept and supervision methods;we should not only maintain a high pressure on illegal construction,but also strengthen public awareness and awareness,and guide the masses to actively participate in the governance of illegal construction.
