On Personal Information Protection Under Epidemic Prevention And Control

At the beginning of the year,a raid on the new crown pneumonia epidemic broke our quiet and peaceful life.In the process of national cohesion and common anti-epidemic,big data intelligent technology has played a vital role in monitoring the development trend of the epidemic,analyzing the track information,investigating potential risk personnel,and formulating prevention and control measures.However,at the same time,because our country has not yet formed a special personal information protection legal norms,the administrative organs to collect and use personal information process supervision is insufficient,the industry has not yet formed an efficient self-discipline sharing mechanism,and citizens own personal information protection awareness of the rule of law is not strong.As a result,the phenomenon of excessive abuse and leakage of personal information related to the epidemic situation is endless,which not only seriously interferes with the daily life and work of citizens,but also hinders the smooth development of epidemic prevention and control work,which is not conducive to the safety and security of personal information,of public health security and national security.Therefore,under the prevention and control of epidemic situation,it is urgent to protect the personal information rights and interests of citizens while using big data technology to realize efficient prevention and control.From the perspective of epidemic prevention and control,this paper focuses on solving the problems of using and protecting personal information related to epidemic situation,seeking the balance between public interest and personal interest,the balance between public right to know and personal information rights and interests,and solving the law value conflict between freedom and order.The State departments concerned and authorized enterprises must strictly abide by the principles of legality,informed consent,proportionality and safety protection when collecting and utilizing personal information concerning the epidemic situation for the purpose of safeguarding the public interest.Finally,this paper puts forward the path of constructing personal information protection mechanism under the prevention and control of epidemic situation from four aspects: perfecting laws and regulations of personal information protection,strengthening the supervision of personal information protection by administrative organs,constructing self-discipline mechanism of personal information protection in industry,and raising citizens’ awareness of the rule of law for personal information protection.In the special period of epidemic prevention and control,it is very important to protect the personal information of the epidemic situation.Therefore,it is necessary for all parties to make concerted efforts to jointly promote the prevention and control of the epidemic situation on the track of rule of law,and realize national governance management system and governance ability modernization goal.
