Conflict And Balance Between Government Information Disclosure And Personal Information Protection Under The Epidemic Situation

Since 2020,China has been under the background of the epidemic,resulting in high social tension.In order to ensure the smooth progress of epidemic prevention and control,the openness,transparency and timeliness of government information have played an important role.However,in the process of collecting information that involves the protection of citizens’ personal rights and interests,the government also takes into account the importance of protecting citizens’ personal rights and interests.However,in practice,the disclosure of epidemic related personal information caused by non-standard administrative behavior occurs frequently.After analyzing many problems and conflicts caused by government information disclosure in this epidemic,this paper suggests that the government should not only strictly follow the principle of proportionality,but also take into account the era background of big data,Data analysis and mining technology may bring discrimination and property losses to the information subject,which requires the government to do a good job in the anonymity and distinction protection requirements for the disclosure of personal information,so as to limit the government’s rational use of personal information;Finally,this paper proposes that the government needs to improve the legal supervision and relief after the damage of personal information rights and interests,balance the relationship between information disclosure and personal information protection,and avoid the collapse of private rights and interests in the face of public interests.
