| The construction of ecological civilization in China has entered a new stage,and the protection of natural environment and wildlife has been regulated by legislation.At present,there is no special legislation on pet animals in China,which leads to social problems caused by keeping pet animals.So far,there is no special legislation on pet animals in China,the lack of legislative norms and the lack of legal protection lead to the survival of pet animals facing difficulties.Based on the current situation of our country,this paper analyzes the necessity and feasibility of pet animal welfare legislation in China,combs and analyzes the relevant legislation of foreign pet animals by using comparative analysis method,and extracts the advanced experience that can be used for reference.For our pet animal legislation to provide relevant enlightenment.This paper is divided into four parts:The first part analyzes the connotation and definition of pet animals,determines the types of pet animals that need to be protected by legislation,and discusses the concept and theoretical origin of pet animal welfare.The second part analyzes the necessity and feasibility of pet animal welfare legislation in China.The necessity of pet animal welfare legislation in our country is mainly reflected in the need to realize the ’five freedoms’ of animal welfare:the need to protect people’s mental health,the need to maintain social order,the need to perfect public health management,and the need to promote social civilization.In the feasibility,the basis of pet animal welfare legislation in legal,social,material,cultural and organizational aspects is analyzed.The third part narrates the situation of the extraterritorial pet animal welfare protection legislation,analyzes the specific situation of the British,American,European Union pet animal welfare protection law and its enlightenment to our country pet animal welfare legislation.The fourth part makes the conception of our pet welfare legislation,the construction of the legislative system and legislative principles,legislative principles are:the principle of coordinated development with economy and society,the principle of pluralistic co-governance,the principle of whole process control and the principle of risk prevention.At the same time,the specific system of pet animal welfare legislation is constructed,and put forward the pet keeping registration system,strict breeder duty system,stray animal aid system,the system of fixed-point reproduction and sale,the system of resettlement of elderly and sick animals,the system of public supervision and reporting,and the system of accountability and punishment. |
