| The promulgation of the " Convention on the Rights of Persons with Disabilities " is the greatest respect and affirmation obtained by persons with disabilities as subjects of rights in the world.Its regulations on the right to education provide guarantee for the disabled to successfully realize the right to education.The signing of the "Convention on the Rights of Persons with Disabilities" in China also provides proof of the inevitability of guaranteeing the right of disabled persons to education.The year 2018 marks the 10 th anniversary of the entry into force of the " Convention on the Rights of Persons with Disabilities " in China.During the ten-year period,the education of disabled people in China has achieved great results.In terms of legislation,in line with the legislative concept of the "Convention on the Rights of Persons with Disabilities",the "Regulations on the Education of Persons with Disabilities" were amended twice,and a "special education promotion plan " was formulated;"The first year of college entrance examination for the blind" and provide reasonable convenience.At the same time,there are a lot of unfavorable phenomena in real life,such as the institutional isolation formed by disabled people entering special education schools,and the quality of education that has been neglected because of the guarantee of access to schools.All achievements and obstacles indicate that the state still lacks the development of the equal right to education for persons with disabilities.Therefore,from the perspective of human rights,this article takes the "Convention on the Rights of Persons with Disabilities" as an entry point,through a qualitative analysis of the equal right to education of persons with disabilities,to explore the equality measures that China should take in specific practices.This article measures the value between the form equality of enrollment opportunity guaranteed by the current status and the substantive equality of educational resources allocation and improvement of education quality,and regards substantive equality as the ultimate goal to guarantee the equal right to education of the disabled.Finally,based on the connection between the disabled and the society,this article finds out the problems existing in the current legislation and practice in China,and puts forward relevant Suggestions to ensure the equal right to education for the disabled. |
