A Research On Protection Of Rights Of Persons With Disabilities

At present, millions of persons with disabilities are segregated and deprived of virtually all their rights, leading a wretched and marginal life. This paper conducts a research on protection of rights of disabi1ities from the perspective of UN convention on the rights of persons with disabilities.Such research starts with theoretical analysis on the basic concepts such as disability; proceeds with analysis and discussion on the models of disabilities and the specific rights of disabilities covered by the UN convention, and concludes with ana1ysis on protection of human rights of disabilities in China, pointing out the current prob1ems there of and bringing forward relevant measures.This paper compares the different models of disabilities, reasoned that the human rights model of disabilities is most effective one to protect the rights of disabilities. The UN convention adopts a human rights model, accept disability as a human rights issue, and require the countries to take appropriate action to remove social barriers.The UN convention covered the unprecedented rights of disabilities. It makes the existing human rights law relevant to persons with disabilities by comprehensively elaborating the full range of internationally-protected human rights from a disability perspective. It's gap-filling and substantive.For purposes of this paper, the research on disabi1ity rights in the field of international human rights 1aw sha1l always be traced back to the protection and promotion of disability rights in China. China has made huge progress in respect of safeguarding disability interests,however,due to the lagging behind of the model of disabilities, inadequate protection to the specific rights of disabilities, the human rights situation of Chinese disabled persons are still far from optimistic,we shou1d go further to update the ideas,perfect the legislation, so as to factually respect, protect, and realize the human rights of disabilities.
