Since its establishment, United Nations keep concerning rights of disabled persons. Convention of the Rights of Persons with Disabilities, which was ratified in2006, is the first international convention about disabled persons launched by United Nations. It has great influence in international society and could be considered as guidance to rights protection for disabled persons in different countries. The research of this essay is mainly about background, content, effect and limit of the convention and it analyses possible challenges the convention may meet and how to deal with them. Under general background of anarchy of current international community and if we suppose it won’t undergo substantial change, effects of human rights conventions of UN won’t rely on contents or absolute number of ratified countries, but rather on the extent that state party accept the conventions and their substantial action such as revising domestic laws or working out an action guideline and programme. UN member states have their own motivations to carry out the convention and they could be divided into inner motivation and outer motivation, in which the first one is a determining factor. In reference to the fact that the convention is a soft law, no matter how we modify the whole structure of the convention including monitoring mechanism and retention mechanism, we should finally promote the whole society to take care of and protect persons with disabilities by raising state parties’ awareness of right protection issue for persons with disabilities. |
