Since the reform and opening to the outside world,China’s economic and social development has been rapidly growing.The concept of "rule by law" has been deeply rooted in the hearts of the people,and the demand for justice has also been increasing.In recent years,the number of cases accepted by the people’s courts has increased by several times,especially in many developed cities,and the pressure on the courts and judges keep growing.Since the Third and Fourth Plenary of Eighteenth Session proposed "comprehensively promote the rule of law" and "promote the judicial rank’s standardization,specialization and occupation,and improve occupation’s quality and professional level”,the people’s court comes to the innovation and development opportunities,followed by a new round of reform of the judicial system in Shanghai,along with other provinces taking the lead pilot,then comprehensive progress is in full swing from top to bottom in every province of the country by batches.The exploration of the establishment of scientific classification,clear division of labor,and the rational structure of the personnel classification management is key to the reform of the judicial system,aiming at building a legal team with standardization,specialization and occupation through the post system reform and relevant management system to achieve the optimal allocation of judicial resources,thereby releasing the burden of work to maximize,improving judicial work efficiency.As the first batch of judicial reform pilot provinces,Shanghai took the lead in implementing the judicial personnel classification management system by posts,divided the officers of the courts in accordance with the proportion of Posts into judges,judicial assistants and judicial administrative staff,with different sequences recruited and work assigned.Though the specialized internal division of labor,clear responsibilities positioning personnel and the division of responsibilities,make full use of human resources to improve the efficiency of the trial work,enhance the judicial function divergently.So far,the reform has gone through more than two years of pilot propulsion,and entered a stable stage.This paper takes Shanghai judicial personnel classification management reform program and related policy as research object,using methods as empirical analysis,policy model analysis,interviews,comparative analysis,to study the implementation of the system,to inspect the effects and problems in practice.Through the comparison of foreign judicial mode of personnel classification management,put forward reasonable suggestions.the lack of academic research on the classification management of judicial personnel has given this paper important research significance.This paper consists of six parts.Part one is the introduction,consist of research background and significance,literature review,research contents and methods.The second part is theoretical basis,including the definition of judicial personnel classification management and related theory.The third part is the analysis of the system implementation analysis,including the current situation,effectiveness,existing problems and causes analysis.The fourth part is the experience of foreign courts’ personnel classification management and their experiments.The fifth part is the countermeasures and suggestions to improve our judicial personnel classification management system.The sixth part is summarizes and prospects.
