| In Reiss’ s book,Translation Criticism: the Potentials and Limitations,Reiss puts forward the theory of typology and classifies text into three types: the form-focused text, the content-focused text and the appeal-focused text.Meanwhile, built on text typology,Reiss analyzes the influence of linguistic factors and extra-linguistic determinants on translation. As a result,on the basis of Reiss’ s translation criticism theory, this thesis is dedicated to the analysis of the English version of the Special Provisions of the Contract Law of the People’s Republic of China(CLPRC).And also this thesis examines how the translation process is influenced by the linguistic and extra-linguistic factors, which builds up a more objective interpretation of the translation of this legal text.First of all, this thesis discusses Reiss’ s translation criticism theory and the factors affecting translation. These factors are linguistic components and extra-linguistic determinants.Linguistic components consist of lexical factor, semantic factor, stylistic factor and grammatical factor.Meanwhile,extra-linguistic determinants are made up of subject matter, immediate situation, audience and speaker factor, time and place factor, affective implications. And then,in the light of Reiss’ s translation criticism theory, this thesis explores the English version of the Specific Provisions of CLPRC,and analyzes how those linguistic components and extra-determinants affect the translation. Finally,a conclusion is drawn: Reiss’ s translation criticism theory regards translation as a dynamic activity in which there are translation function, original author, translator, audience, time and space,so that it can provide a scientific, objective and feasible guidance for the translation of legal texts. |
