China’s civil nuclear industry has made remarkable achievements in the past forty years.China has become a great civil nuclear industry country in the world.Since the Trump Administration came into power,the tendency of unilateralism in the United States has become more serious,which has triggered Sino-US trade disputes.In October 2018,the Department of Energy of the United States issued "U.S.Policy Framework on Civil Nuclear Cooperation with China",which caused the Sino-US trade disputes to seriously influence China’s civil nuclear industry.The fundamental reason for the "framework" lies in the fact that the United States obstructs the strong development of China’s civil nuclear industry and the "going out" strategy of civil nuclear industry of China in order to restrict China from competing with the US in the field of civil nuclear in the international market.Therefore,the implementation of "framework" seriously affects the efficiency of China’s civil nuclear industry development,China’s "going out" strategy of civil nuclear industry,and even the improvement of Sino-US trade relations.Therefore,in order to relieve the negative influence,the paper applies literature and case law methodologies to do research on the legal issues and countermeasures of China’s civil nuclear industry in China-US trade disputes.From the perspective of foreign countries,this paper examines the legal response measures of France,Japan and South Korea in the trade disputes with the United States,summarizes the general rules,and draws experience and lessons from them,so as to provide rich experience and reference for China to deal with the United States sanctions.Finally,in view of the above-mentioned legal problems,the paper provides legal response for the development of China’s civil nuclear industry and the "going out" of civil nuclear industry from four ways: filing a lawsuit in the United States;resorting to the WTO dispute settlement mechanism;using Chinese laws to counter the sanction;and improving the comprehensive management of independent intellectual property rights.
