Research On The Settlement Mechanism Of Industrial Injury Disputes Of Rural Migrant Workers In Construction Industry In Deqing County

With the rapid economic and social development,China’s migrant workers engaged in the construction industry have become a large number of social forces.However,due to the high risk of their profession and their low cultural level,the number of labor disputes caused by work-related accidents is particularly high in the construction industry protruding.The vital interests of migrant workers are deeply involved in many major national strategic issues.Whether their rights and interests are properly handled and coordinated is related to the legal adjustment of China ’s labor relations and the construction of a harmonious society.Therefore,how to establish a long-term mechanism to effectively deal with industrial injury disputes has become a key and difficult issue in basic social governance.It started the construction of a multi-resolution mechanism for contradictions and disputes in June 2018 in Deqing County.However,due to the short operating time of the mechanism and lack of relevant operating experience,there are still major problems in the allocation and coordination of various resources of the mechanism.At present,the proportion of work-related injury disputes in the construction industry that are resolved through legal procedures is only over 40%,indicating that there is great room for improvement and development of the multi-resolution dispute resolution mechanism.Therefore,it is of great significance to conduct a systematic multi-resolution dispute resolution analysis and countermeasure research based on Deqing County.This paper expounds the status quo of the construction of a multi-dispute resolution mechanism in Deqing County,and uses qualitative analysis of the bottlenecks and causes of the dissolution mechanism by using interview methods and typical case analysis methods.Finally,it proposes countermeasures based on social governance theory and synergy theory.Studies have shown that the Deqing County’s multi-resolution dispute resolution system has achieved some results since its operation for more than a year,and the local dispute resolution rate is significantly higher than before.However,due to the multiple management of the system,insufficient investment in the unified platform construction,the failure to implement the main responsibilities of the employers in the construction industry,and the limitations of the social forces themselves,the supporting system of this mechanism still lags behind,the management model of the grassroots resolution institutions has not been unified,and disputes have been resolved in long-term chaos,social forces have not yet achieved in-depth participation in the resolution of industrial injury disputes in the construction industry.To this end,this paper proposes a series of measures for the purpose of strengthening the construction of a unified platform to improve the supporting system which is under the leadership of the government,including the prevention,tracking,research and judgment of work injury,information sharing between government departments,program connection and talent construction,etc.In addition,we should strengthen management of construction site and the institution to prevent safety accidents,strengthenlaw education and promotion of rights protection methods for migrant workers,and strengthen the participation of social forces in the form of government purchase of services,etc.Our purpose is striving to improve the system design and the efficiency of the resolution of work-related injury disputes,to make migrant workers in construction industry in Deqing County enjoy a more stable and harmonious Social environment.
