It is inevitable for the disputes during the construction of projects because different people has different ideas from different position. And it will be worse if they have huge disagreements with each other, which will cause legal proceedings. Once the legal proceedings happen, it will cost a lot for any side of the proceeding and finally they maybe can not agree with the final decision of the court, which will affect the project plan and also affect the benefit of each side.According to the disput cases and related data, this kind of disputes can be reduced by the actions below: build up experimental model based on factors that can have a big affect to the whole project; foresee the and prevent the disputes; analyze the factors that would result in disputes and take reasonable actions to control.This thesis collects and analyze construction disputes, by reviewing factors that can cause disputes like management and organization of customers and contractors, relationship, project scale, budget plan, contract and risk management, project scope. Finally it can be concluded into three factors, process, person and project. And make questionnaire based on these factors. The questionnaire is collected and analyzed by internet and on site providing. Factor analysis achieved 9 factors and based on that the prediction model can be built. This model can be verified by real cases.By building this model, it can help the management people of the project to relealize the factors that will cause disputes, so they can find the potential problems and root cause, also it can help both sides of the contract to improve the agreement and build a good construction envoirenment and the win-win result. |
