Research On Construction Engineering Contract Management Mode Under Company Lawyer System

With the prosperity of China’s construction market,the role of construction engineering contracts in engineering is becoming more and more important.It is the link to coordinate the parties involved in the construction project.Therefore,effective management of it has increasingly attracted the attention of the participating departments.However,there are still many ills in the contract management practice in China.For instance,the legal awareness of both contract parties was weak,the construction contract management system was not taken seriously,the method of construction contract management was extremely backward,and the professional talents were truly scarce.All these problems have seriously hindered the improvement of the construction contract management level and the development of many enterprises in China.In order to survive and develop in the fiercely competitive construction market,building development companies were trying to improve their own contract management capabilities.the"Opinions on the Implementation of the Legal Adviser System and the Lawyer System of Public Lawyers" issued by the General Office of the CPC Central Committee and the General Office of the State Council in June 2016 pointed out the new direction of efforts for the construction and development enterprises.Based on reflections on the problems existing in the construction contract management,and in view of the advantages of the corporate lawyer system,the thesis innovatively proposes a new model for running construction contract management under the corporate lawyer system.After reviewing the traditional construction contract management,for its shortcomings,the thesis optimizes the structure system of the existing corporate lawyer system,proposes a new organization method of it.And based on this,the thesis systematically analyzes and describes how the corporate lawyer system plays its role in the process of construction contract management.In this way,the corporate lawyers can participate in every part of the construction contract management.It means that from the stage of decision-making before signing the construction contract to the stage of contract review and to the stage of contract performance or even to the stage of post-processing contract controversy,the corporate lawyer are deeply involved in the process of the construction contract management.Through the engineering examples,the promotion effect of the new model in the process of improving the management level of the construction contract was supported in the last part of the thesis.Through these methods,the corporate lawyers will not only have knowledge of laws and regulations related to construction contract management,but also gradually deepen their understanding and comprehension of the construction project,so that the new model for running construction contract management under the corporate lawyer system can protect the prosperous and boost of the whole company.
