Abstract/Summary:
With the rapid development of China’s economy and the people’s longing for and pursuit of a better life,the national government’s investment in infrastructure construction is increasing.Especially with the advancement of comprehensive and deepening reforms and the continuous and systematic reform and optimization of the development of the construction industry,various laws,regulations,and regulatory systems have been increasingly improved.In the current construction market,contract management runs through the entire life cycle of project management.The contract management capabilities of all parties involved in the project are different,especially the difference in the contract management capabilities of the dominant owner.This has resulted in losses and disputes among the participating parties.In project management,the construction contract management of the project owner in the core dominant position not only involves huge amounts of money,but also plays a different role in project management.Although there is currently a model text of the construction contract(GF-2013-0201),its special clauses for the construction contract mainly enumerate a rough list,without further clarifying the substantive content.Sometimes,because the owner only pays attention to some of the terms in the construction contract management,such as: contract price form,progress payment,change principles,project personnel and other terms,sometimes these terms are rough and general Contradiction with laws and regulations.The content of many construction contracts is imperfect,and even overlord clauses have appeared,resulting in invalid contracts,which have caused conflicts between two or more parties to the contract.With the development of the construction industry and the increase in the degree of marketization of construction,sometimes a party to a contract does not use the terms of the contract in order to preserve the interests,but uses other means to resolve contradictory issues.Therefore,strengthening the overall management of the construction contract of the project owner has become an important subject of project management research.This article starts from the international and domestic status quo of construction contract management,and mainly analyzes the reasons behind the status quo,such as:non-standard contract signing,inequality between contract parties,weak contract management awareness,unsound contract laws and regulations,market Weak supervision,etc.Based on the analysis of the status quo reasons and the study of relevant contract basic theories,targeted methods and countermeasures are proposed.Finally,through the case to systematically discuss the feasibility,rationality and scientificity of the construction contract management methods and countermeasures.Through analysis and research,the construction contract management of the owner is a systematic management project.It not only involves a single person or a single unit or a single project,but from the perspective of the management of the entire project of the owner,realizes the division of labor and cooperation,and undertake his own responsibilities,from the overall members,the overall project and all aspects of the entire cycle of the project to all parties involved in the project to jointly promote the construction contract management of the project.In view of the complex construction contract management environment,the construction contract management macro-refines the contract organization,implements the responsibilities and obligations of contract management personnel,and regulates the setting of contract content clauses;at the same time,from the micro-details,the project The cycle,that is,the PDCA cycle management of the construction contract from the tendering stage,the implementation stage,the completion stage,and the termination stage to achieve the perfect construction contract management system,so as to resolve various risks in the construction contract management and improve the construction contract management The actual effect.This article takes small and medium-sized owner projects invested by state-owned assets as an example,and based on the owner ’s contract management of project construction general contracting,puts forward the theory and method of systematic construction project construction contract management.The management system will effectively enhance the project management capabilities of the owner and create a benign and healthy construction market environment.
