The Theoretical Basis And Perfect System Of Central Ecological And Environmental Protection Inspector

As a major reform of the ecological civilization mechanism,the central government’s ecological and environmental protection inspectors have vigorously promoted historic,transformational and global changes in ecological and environmental protection.It has a high political attribute,administrative supervision attribute and ecological attribute,which has important legal value for strengthening the legitimacy of environmental governance,consolidating the consistency of central and local environmental administrative order,and extending environmental legal responsibility within the administrative system.From the legal basis,the ecological civilization into the constitution and the institutional environment of China’s unitary centralized state provide the constitutional foundation.The theory of environmental administrative law,the system practice based on the balance of interests and the bureaucracy system provide the foundation of administrative law.《Regulations on supervision of central ecological and environmental protection》and other inner-party laws and regulations provide the theoretical basis of inner-party laws and regulations.From the perspective of practice,at the level of organizational law,China has established the central ecological and environmental supervision agency and defined its functions,and its members are highly configured.At the level of behavioral law,it has been clear that the basic objects of supervision are local party committees,governments and related departments,forming clear working procedures and programs and paying attention to the role of public participation.However,the central ecological and environmental inspectors still face the apparent resistance that the problems pointed out by the inspectors have not been well solved,the hidden resistance of the "one-size-fits-all" measures taken to deal with environmental inspectors,and the concerns and disputes generated by large-scale accountability.Based on the analysis of the central environmental supervision system based on development economics,corresponding measures should be taken in different periods of economic development.Based on the data of Beijing and four other provinces and cities,we can see that supervision is not the main factor restricting economic development.Therefore,we should further promote the in-depth development of ecological supervision by establishing organizational norms and behavioral norms.
