Research On Legal Issues Of Air Pollution Prevention And Control In Xingtai City

Around 2013,Xingtai City,where environmental problems have accumulated for a long time,ushered in an outbreak.The severe haze weather continued to shroud.The air quality is directly at the bottom of the country.The prevention and control of air pollution is urgent.Although the entire Beijing-Tianjin-Hebei region is the worst-hit area of environmental pollution,all walks of life focus on pollution prevention and control research in Beijing.Xingtai City has a certain degree of particularity in factors such as geographic environment and industrial layout,so Xingtai City’s air pollution prevention and control measures Special research is very necessary.On the one hand,it can provide theoretical guidance for the specific implementation of air pollution control measures;on the other hand,it can provide the corresponding legal basis for Xingtai environmental law enforcement.This paper,through the research on the air pollution status and prevention measures in Xingtai City,finds out the existing legal problems,and puts forward corresponding legal countermeasures according to the prevention and control measures of some representative cities at home and abroad.The first part shows the current situation of air pollution in Xingtai City from the three aspects of pollutants and their sources,the time characteristics of pollution and the spatial characteristics of pollution,and introduces the harm caused by pollution:On the one hand,traffic jams bring obstacles to travel;on the other hand,it is harmful to people’s health,causing people to suffer from respiratory and cardiovascular diseases.Then it analyzes the causes of pollution from both natural and man-made aspects.Natural causes are mainly geographical and climatic factors,while man-made causes are divided into corporate pollution,motor vehicle pollution and domestic coal-burning pollution;the second part is based on pollution sources.List the measures taken by Xingtai City to prevent and control air pollution from the aspects of industrial enterprises,motor vehicles,domestic coal burning and non-point source pollution,and analyze the problems of these measures from the aspects of local legislation,government law enforcement,judicial relief,and public participation;The third part is represented by the foreign cities of Los Angeles and London,and the domestic cities of Beijing and Shijiazhuang.From their pollution prevention experience,they have drawn effective enlightenment for Xingtai City: perfect legislation is the basis of pollution prevention;sound institutions are the backing of pollution prevention;Judicial relief is the traditional way of pollution prevention;public participation is the guarantee of pollution prevention and control.the fourth part puts forward the corresponding countermeasures for the current legal problems of pollution prevention and control in Xingtai City: speed up at the legislative level The local legislative process is divided into two aspects: refinement of the upper law and revision and improvement of the current law;the level of law enforcement should improve the level of government governance,including the establishment of a coordinated governance mechanism for various departments and strict law enforcement to improve the level of law enforcement;at the same time,we must pay attention to judicial relief: Clarify the qualifications of litigation subjects,establish specialized judicial authentication institutions,and clarify the charging standards for various fees in litigation;finally,improve the public participation system,including the environmental information disclosure system,public supervision and public participation relief system,and conduct publicity and education of environmental legal knowledge.The proposal of legal countermeasures is the core part of this article.
