Study On The Legalization Of Green Exploration

In the context of the Party Central Committee’s proposal to build an ecological civilization,China’s mining industry has embarked on a path of green development.Green exploration is the concrete practice of the concept of green development in the field of mineral exploration,it is based on a new exploration measure or method which meets the environmental protection requirements and achieves the prospecting effect,and it is an inevitable requirement for China’s ecological civilization construction to construct and perfect the legal system related to the green exploration,it is also the fundamental need to protect the ecological environment in an all-round way.This paper introduces the meaning of green exploration,and highlights the importance of the legalization of green exploration from both macro and micro levels,the development and evolution of green exploration system are introduced from three stages: Concept Advocacy Stage,pilot exploration stage and demonstration standard stage.This paper summarizes the social status of the traditional mineral exploration model and determines the theoretical basis for the construction of the legal system of green exploration,in addition,the comparative study has drawn on the effective experience of foreign countries in the construction of legal system concerning environmental protection in mineral exploration,on this basis,it analyzes the relevant legal systems in the existing legal system of mineral exploration that are not conducive to the implementation of green exploration management,from the administrative management system of green exploration,such as qualification system,property right system,environmental evaluation system,the improvement of administrative behavior,green exploration standard system,legal responsibility system,etc.For the construction of the legal system of green prospecting,I propose to take the environmental protection law as the Basic Law,to formulate the special law on green prospecting,and to complement and improve the laws,regulations,policies and standards of the state,local governments,and industries,etc.,we will continue to improve the legal system for green prospecting.
