Research On The Legal Issues Of Straw Pollution From The Perspective Of Environmental Rights

Environmental pollution restricts the high-quality development of the country and economy,and environmental protection and governance have become an important part of the great rejuvenation of the Chinese nation and the realization of China’s goal of prosperity and strength.As an environmental pollution problem,straw pollution has always attracted attention,and relevant functional departments are constantly taking measures to actively respond,but they have not fundamentally solved the related problems.The rule of law is the best mode of social governance.Solving related problems through legal regulation is in line with the essential requirements of governing the country by law.Therefore,if the straw pollution problem is to be solved properly,it must return to the path of legal regulation.Using legal thinking and right-based thinking,the solution to the ecological and environmental problem of straw pollution control will inevitably be inseparable from environmental rights.Because environmental rights are the product of the people of the world who actively respond to the crisis caused by ecological and environmental problems and use the rule of law thinking to actively respond,and it is an important practical result of seeking sustainable development.Therefore,researching from the perspective of environmental rights provides a feasible and optimal plan for the comprehensive management of straw pollution in my country.Through indepth research,on the basis of the existing comprehensive management system,new ideas and new methods to break through the predicament are sought.That is,to promote the continuous improvement and development of the existing environmental protection system and the straw pollution regulatory system with environmental rights as the starting point and end point.Improve the shortcomings and deficiencies of each link of legal regulation,and make dialectical suggestions on the relevant legal level.Provide a theoretical basis for the improvement of domestic ecological and environmental protection related legal systems and the effective implementation of national and local policies.Faced with the problem of straw pollution control,through the actual case and the objective actual situation after the investigation at the grassroots level,the current situation of straw pollution control in the current practice link is fully understood and analyzed.On the basis of grasping the basis,starting point and source of straw pollution regulations,namely,straw resources and the related content of their pollution status,re-clarify the system structure and concepts,and improve the related content of straw pollution regulations.From the perspective of environmental rights,we reviewed the current situation of my country’s straw pollution legal regulations,combined with case studies and the actual situation of grassroots investigations,and found deficiencies.In the face of my country’s existing straw pollution legal and regulatory system,imperfect judicial relief mechanism,lack of environmental education system and other issues,optimize the regulatory legal system and content,establish environmental rights at the constitutional level,and establish and perfect an ecosystem with environmental rights as the core Environmental protection system;improve judicial relief channels and methods,clarify the status of judicial relief under the framework of environmental law,and improve its functions;implement environmental education guarantee mechanisms,so that people’s environmental behavior can be adjusted,and ecological environmental protection can be healthy and sustainable development of.Finally,a more scientific and effective way to solve the related straw pollution problems,to protect the sustainable development of ecological economy and the construction of ecological civilization.
