As a key ecological protection area,wetlands have made indelible contributions in regulating climate and protecting ecological diversity.It can be built as a natural scenic spot,attract many tourists and develop tourism industry.It can also be used as a habitat for wild animals and plants.The scientific research value can not be ignored.The enactment of local legislation on wetland protection will help guide the government and the people to abide by the law and increase the importance of such areas,which will help strengthen ecological civilization construction and advocate green development,it is very important to set up a correct view of ecological protection.Compared with 53 provincial wetland protection legislative texts,it can be found that the domestic wetland protection and management system is prone to the situation of "leaderless" There are six other provinces that do not currently have provincial wetland protection regulations: Guangxi Zhuang Autonomous Region,Liaoning,Henan,Shanghai,Shanxi and Chongqing;In the provinces where regulations on wetland protection have been issued,a wetland protection planning system has been established,but only 15% of them have complete planning contents.In terms of legal liability,the main part of the penalty is the assumption of administrative liability,and the main form of punishment is the fine,in the penalty amount standard,each place difference is big,the penalty span is big,the law enforcer has the very big free discretion space,and the penalty amount is generally low.The defects of local wetland protection legislative text include: Legislative Idea Lag,legislative technology rough,legal unity,applicability,not prominent Operability,low cost of crime,less punishment;The legislative system of wetland protection is not perfect,and there is a lack of high-ranking laws and special legislation of wetland protection.In order to strengthen the unity of legislation,improve the quality of legislation and implement the legal responsibility,the following countermeasures are put forward: First,make clear that the concept of green development is the concept of local wetland protection legislation,and strengthen the construction of Legal Talents;second,we will improve the establishment of local legislative systems for wetland conservation,establish a wetland ecological compensation system and a Local ordinance system;third,improve the quality of local legislation,fourth,to establish a unified legal system for the protection of wetlands and promulgate national regulations on the protection of wetlands as soon as possible,realize the systematization of legislative technology.
