Environmental Law Enforcement Of China’s Imported Solid Waste

In China,for the problem of ecological environment damage caused by the illegal transfer of imported solid waste into the country,we have adopted a multi-sectoral joint law enforcement approach to combat such illegal or criminal acts.However,there are still many problems in domestic environmental law enforcement,which cause environmental pollution of imported solid waste.The accident has still not been effectively contained.In order to ensure that the prevention and control of ecological and environmental pollution in coastal areas and villages and villages have achieved good results,the following research is conducted on the causes and existing problems of cross-border environmental solidarity crimes of imported solid waste based on the current status of domestic environmental law enforcement.The full text is divided into five parts:The first part is an overview of imported solid waste.Imported solid waste refers to solid,semi-solid,and solid waste that can be imported for industrial processing and utilization,which was originally permitted by the National Imported Solid Waste List.In practice,illegal smuggling such as evasion of supervision has caused great pollution to China’s environment.The second part is the status of environmental enforcement of imported solid waste.The main body of environmental law enforcement refers to the department responsible for environmental protection,involving many departments such as customs,environmental protection,quality inspection and quarantine,housing construction,comprehensive law enforcement bureau,and industry and information bureau.Due to the lack of a unified coordination mechanism,the division of powers and responsibilities in the process of law enforcement is unknown.It has affected the work of law enforcement agencies such as customs and ecological environment to a certain extent.Coupled with a single law enforcement method,inadequate compulsoryness,and lack of specific identification standards,the illegal and criminal activities of the transboundary movement of imported solid waste have not been effectively prevented.The third part is the problems in environmental law enforcement of imported solid waste.First,the implementation of the main functions of environmental law enforcement is not in place,the functions are not clearly defined,and the departments lack coordination.Second,the law enforcement procedures are not strict,the means are insufficient,there are violations of law enforcement procedures,and the internal monitoring mechanism fails to exercise restraint effects.The third is solid.Waste identification is difficult,and there are no specific property identification standards and sampling technical specifications forimported solid waste.Existing standards have not been effective due to inconsistent identification.The fourth part is the investigation and reference of environmental law enforcement of imported solid wastes outside the region.Through the investigation of environmental law enforcement practices in the United States,Japan,and South Korea,it is concluded that the characteristics of law enforcement are strong administrative penalties,scientific discretionary standards,and diversified law enforcement methods.This is also an experience worthy of reference in China’s current environmental law enforcement practice of imported solid waste.The fifth part is suggestions to improve the environmental enforcement of imported solid waste.First of all,it is necessary to clarify the functions of the main body of environmental law enforcement of imported solid wastes;secondly,to increase the means of environmental law enforcement of imported solid wastes;and finally to improve the standards for environmental law enforcement of imported solid wastes in China.
