Study On The Legal Principles Of River Resources Use Management

With the rapid development of China's economy and the acceleration of social modernization process,people's expectations for a good ecological environment are increasing.At present,the rough development of river resources development and utilization,too many management subjects,economic benefits as the focus,and serious damage to the ecological environment,which are not in line with the current social development needs,are paid more and more attention by the state and the public.It is necessary to conduct in-depth study on the use management of river resources.In fact,the use management of river resources is also a further refined management mode of river management,which is one of the important means to effectively improve the utilization rate of river resources and protect the ecological environment of river channels.There are many problems in river management in China,such as frequent illegal cases,scattered and uncoordinated laws and regulations,lack of unified river resource use management planning,weak binding force on the main body of river resource use management,and lack of public participation in the formulation and implementation of laws.One of the main reasons for these problems is that the laws and regulations of river resources,such as water law,land law and environmental protection law,which are involved in the management of river resources use,are inconsistent,incomplete and disagreeable.In this paper,different laws and regulations have conflicts on the protection of river resources in actual cases,leading to the emergence of a legal system that classifies the management authority of river resources into different administrative subjects according to law,and then analyzes that due to different law enforcement powers of different administrative bodies,the local resources of river resources are divided into separate management according to law,but there are overlapping conflicts,and the river resources are not systematically managed It is difficult to form effective joint forces and other legal issues.This paper puts forward six aspects,including overall planning,protection and development,ecological compensation,statutory management authority,public participation and increasing punishment.It also conceives the basic principle system of river resources use management law,and further improves the relevant contents of existing river resources laws and regulations,so as to provide the principle construction for legislation,law enforcement and judicial activities of the legal system of river resources use management in China Design provides reference.
