Study On The "three Rights Separation" Of Agricultural Land In China Under The Theory Of Land Property Rights Of Marx

At present,China is in the period of deepening the reform of the property right system of rural land.In order to comply with the wishes of farmers to retain the right of land contract and transfer the right of land management,the state has put forward the policy of "separation of three rights" of rural land,which implements the separation of ownership,contract right and management right of rural land,and enlivens the right of land management.In recent years,under the guidance of relevant national policies,the practice of "Three Rights Separation" of agricultural land in China has been steadily promoted,and some achievements have been achieved.On the whole,the moderate scale operation of agricultural land has been preliminarily realized,and the further development of agricultural modernization has been promoted.However,in practice,there are some problems,such as the infringement of farmers' rights and interests,the irregular transfer of land management rights,and the conflict of interests between farmers and new management subjects,which affect the further promotion of the practice of "Three Rights Separation".Therefore,it is of great practical significance to study the "Three Rights Separation" of farmland.Under the guidance of Marx's theory of land property rights,this paper combs the current situation of the practice and development of the "Three Rights Separation" of farmland in China,finds out the existing problems,explores the causes,and tries to find out feasible solutions,so as to provide a theoretical reference for the further development of the practice of the "Three Rights Separation" of farmland in China.This paper mainly includes the introduction,the main body and the conclusion.The main body is divided into four parts:The first part is an overview of the relevant content of the "Three Rights Separation" of agricultural land,and expounds the main content of Marx's theory of land property rights and its guiding significance for the "Three Rights Separation" ofagricultural land.The second part is to sort out the current situation of the practice and development of "Three Rights Separation" of farmland in China.This paper summarizes the basic situation and typical model of the practice of "Three Rights Separation" of farmland,affirms its achievements,and puts forward three main problems in practice: the infringement of farmers' rights and interests,the irregular transfer of land management rights,and the conflict of interests between farmers and new management subjects.The third part is to explore the reasons for the problems in the practice of "Three Rights Separation" of agricultural land in China,mainly including three aspects: the subject of property rights of agricultural land is vague,the market of agricultural land transfer and transaction is not mature enough,and the distribution of interests among the three rights subjects of agricultural land is unreasonable.The fourth part is to put forward countermeasures and suggestions to solve the problems in the practice of "Three Rights Separation" of agricultural land in China under the guidance of Marx's theory of land property rights: to clarify the property rights of agricultural land according to the theory of land property rights and its unity and separation,to perfect the market system of agricultural land transaction according to the commercialization of land property rights and the marketization of allocation,and to establish a reasonable distribution mechanism of agricultural land interests according to the theory of land rent.
