A Study On The Transfer Of Farmland Under The "Three Right" Division Model

China is a large country with a population of more than 1.3 billion people,and the contradiction between people and people is always accompanied by the process of agricultural modernization.In the context of urban-rural integration,how to achieve social equity and justice,as well as efficiency and fairness,has always been a major practical problem.Since the founding of new China,especially since the reform and opening up,China has made many explorations on the reform of land property rights and the practice of land circulation.The evolution of rural land property rights also moved from the stage of "two rights” separation to the "three right" stage of agricultural land.Under the new land property right system of "three rights",the rural land still insists on the collective ownership of farmland,and the contracted right of farmland contract will be divided into two independent property rights.For the separation of agricultural land management rights,the right to use,use right and usufruct of agricultural land will be separated from each other and recombined.With the development of social economy and the deepening of comprehensive reform,there are still some problems in the research and practice of farmland transfer under the "three rights" of agricultural land.To this,from the perspective of Marx's property rights theory,this paper uses the many kinds of research methods,from the political,economic,social and other aspects to analyze the current rural land circulation problems,and tries to based on Marx's land property rights and power and separation theory,the commercialization of land property rights theory and the current development of social productivity,farmland circulation in our country the problems put forward scientific advice.The article mainly discusses from five aspects.The first chapter is the introduction.It mainly consists of the background of topic selection and literature review.The second chapter introduces the basic concepts of rural land and “three rights”,and expounds the theory of land property rights of Marx.The third chapter studies the historical evolution of rural land circulation in China.This paper analyzes the scientific advances of the rural land transfer from the initial stage to the final agricultural land "three right".Farmland "separation" in the fourth chapter discusses the division mode,the land circulation development of the existence of dilemma,involved in the game of conflict between farmland separation,the vacuum of collective land right,laws and regulations as well as compensation standard,and the subsequent solutions discussed to provide corresponding basis.The fifth chapter,according to the guidance of Marx's land property rights theory,first made clear in the progressive reform on the basis of the existing system,according to prominent problem,put forward the farmland contract right exit mechanism,establishing the agriculture information service system,to set up the reform of land circulation fault tolerant measures and related measures.In the end,the author summarizes the thesis and hopes that the research results can be used for reference in the future development of rural land transfer.
